Like I said the chance of you getting a letter before action is very small but if you do come back on here for advice of how to reply to it.
Put that to the back of your mind.If you go down to the woods today you better not go alone.0 -
if you offer in letter before action and an income expenses asset info to creditor then what more can they expect, that's all you can give and it would waste their time getting a court to force you to give exactly the same sheet you just gave to creditorChristians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

You only need to worry about that IF you get one - it will be marked letter before action.collinsona said:Thank you Floss- if I respond to the letter before action does that mean the action wont be taken?! You need to have missed payments before you get a default, it's not something that can just happen like that.collinsona said:Also before I knew not to ring the creditors I rang tesco bank and after an hour and a half the guy offered to default my account there and then- should I have accepted? Weird that he offered to do it for me then? To be honest although he was nice I felt like he had no idea what I was actually asking him to do! But surely he wouldn’t have offered if he couldnt actually go through with it? Strange! It doesnt matter now anyway. Amy x

That is one reason we say never phone. He was probably working off a script in a call centre and when you asked him something that wasn't on his script he made it up.collinsona said:Weird that he offered to do it for me then? They will always accept whatever you are willing to pay. Best thing to do is not to engage in any conversation with creditors over the phone. Normally at the back of any letter they send , you can find how to pay them and one way to pay is by standing order. That’s what I’m doing anyway, not even once I spoke with anybody or provided any information about my income. You are in control , your creditors are not. If at any time they refuse my payments, they will get nothing. I’m pretty sure they will carry on accepting my payments.collinsona said:This is probably a really stupid question but once the credit card company defaults my debt could they then not accept my payment offer and just demand the whole amount back? And if I dont pay it all back take me to court? Or am
I letting my imagination run away with me as usual? If anyone has rung the CC company to make a payment offer after a default could you give an an example of how the conversation went please?! Thanks in advance Amy x1 -

Amy, you have been given a plethora of information, in such a short space of time, on virtually every aspect of the debt collection process and its endless possibilities, and how they may affect you.collinsona said:Do they still send statements showing yojr balance going down or not? Amy x
Try and slow things down a tad, concentrate on what happens, rather than what might happen.
Section 77a of the consumer credit act requires creditors to supply a statement to you, not more than once a year, so long as a balance remains payable on the account.
This applies to original creditors as well as debt buyers who purchase debts.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
