Consumer rights for shoes?

Hi all,
I purchase a pair of running shoes, which developed a hole within the first few days. I have contacted the shop I bought from and they have asked me to send them back and they will then refund me or send me a new pair. My question is, is it within my rights to request the replacement pair before I send them back? I need the shoes for training and can't really wait a week or so for them to receive mine, then to send a new pair etc. Any advice would be great! thanks

Assuming it is under 30 days since receipt you can reject the goods for a full refund or return them and leave it to them to decide if to repair, replace or refund.
What most would do is buy a replacement and then return the originals for a refund but there is the risk that when they get the old ones back they argue that you've damaged them rather than it being a fault and so return them in their current state leaving you with two pairs.0 -

Have the shop seen photos and accepted that the shoes are definitely faulty? If so, you may be able to persuade them to send replacements first (even if you have no right to insist), but if they're waiting to see them before deciding then you don't really have any choice other than to wait.imamutant said:I have contacted the shop I bought from and they have asked me to send them back and they will then refund me or send me a new pair. As a regular runner, who needs the shoes for training, and having had the new shoes only a few days, can you use your previous pair of running shoes in the interim?imamutant said:Hi all,

I think it is reasonable to ask for them back before offering a refund, they will want to check them out to ensure they are the pair you have bought from them.1

The regs don't say much about this other than the trader is to cover the costs of a repair/replacement (including postage) and must do so within a reasonable time and without significant inconvenience but ultimately if they didn't you'd then reject which comes with the duty to return/make available for collection anyway.
It's pretty normal for customers to return goods first and I think in this instance arguing significant inconvenience not only doesn't live up to it's intention under the regs but pragmatically speaking doesn't help you either.
As above you can ask but if they won't accommodate best just to return and wait on the replacement.

It's very unusual for running shoes to fail like this within a few days. The only time it's happened to me is when I used them for a purpose for which they weren't intended.
As @Grumpy_chap asks, can't you use whatever shoes you were using before?
(Top tip for runners: when buying new shoes don't bin the old ones until you know your happy with the new ones. Better still - keep two pairs on the go...)0 -

(I could probably open a running shoe shop myself. Problem is buying more shoes doesn't make you run faster for somereason )1
