Thank you - so my next step is to appeal to POPLA using a template from one of the threads and clearly state that i, as the keeper decline to identify the driver? The driver is unknown to MET. The known keeper is not liable and MET cannot infer that they were the unknown driver. Once the keeper tells them that they decline to identify the driver, that is the end of the road for MET. POPLA will assess that the PCN has not been issued correctly and MET should have re-issued the PCN to the driver… who they don’t know who that is.0 -
Most POPLA appeals are made up of as many points as possible. You only have to win a single point. It is usual to throw the kitchen sink in a POPLA appeal.
The main points:
1. No keeper liability
2. No evidence that person they are pursuing is the driver
3. !!!!!! signs
4. No evidence of landowner authority to issue PCNs
5. Any failures of the BPA Code of Practice you can find.
