Tesco Horizon PCN

Hi,

Recently received PCN letter from Horizon for alleged overstaying. I have disputed it today on their website, using the blue template (did not change anything l, just copy-pasted). I also wrote below email to Tesco:

“Dear Mr. Murphy,

I hope this message finds you well. I am writing to bring to your attention a deeply disappointing issue concerning a recent parking charge notice issued by your parking agent, Horizon, following a visit to your store.

On 20/07/2024, my family and I visited the Tesco store at … to spend some cherished time together. My parents, who travel to Scotland only twice a year to see their grandson, accompanied us. We enjoyed a pleasant time at the cafe and then did some shopping, making the most of the visit to Tesco as a venue for our rare family gatherings.

However, this positive experience was overshadowed when we received a Parking Charge Notice from Horizon for allegedly overstaying in the parking lot.  It is incredibly disheartening and unfair to be penalized for choosing Tesco as the place to spend valuable family time.

As loyal customers who appreciate Tesco's commitment to quality and service, being treated this way feels unjust. Honest customers who aregenuinely enjoying the facilities and services your store offers should not be pestered with parking charges. Additionally, during our visit, there were ample free parking spaces available for other customers. This makes the overstay penalty even more unreasonable, as our presence did not inconvenience other patrons or limit their access to parking.
 
I have already made an appeal to Horizon, I kindly request your intervention to have this parking charge canceled.
 
Thank you for your attention to this matter. I look forward to your response and a favorable resolution. I hope to be able to continue to shop at Tesco without fear of such penalties in the future.

I received the below response:

“Good afternoon
Thank you for contacting our Chief Executive's office.

I am sorry that you have received a parking penalty charge that you feel is unjust. However, regardless of the other parking spaces being available, the rules of parking are clearly laid out. In this case there are 10 signs around the car park and one on entry. 
Unfortunately, I am unable to waive your penalty charge.
However, you advise that you have appealed to Horizon directly. Horizon are very fair and all appeals are judged on their own merit.

Did I word something wrong on my email or made some errors? Or I should’ve expected response like that?

    Reply and say Horizon are not renowned for being 'very fair' and you have no idea why Tesco are putting a member of a known rogue and unregulated industry before the interests of their customers. Tell them you kindly request again, that Tesco to support you and simply email Horizon to cancel the PCN.

    If you live in Scotland you can ignore this PCN, debt collectors letters etc and eventually it will go away.

    If you live in England post a redacted copy of Horizons NTK for comment. They often are not POFA compliant so cannot hold the keeper responsible unless someone tells them who was driving
  • That’s correct, I live in Scotland - thanks a lot, that’s very good to know this can be ignored. I wrote another email to Tesco anyway, before seeing your reply (as Coupon-Mad advised, no mention of driver)

    Rules and laws are different in Scotland, hence why its an important aspect of the case 

    Currently no keeper liability in Scotland

    ChatGPT… ugh! Nausea inducing prose. I wonder if that is why you received the response you did from Tesco.

    Scotland… no keeper liability and can be ignored as long as the keeper doesn’t blab the drivers identity.

    I have to agree with LDast that letter was vomit inducing rubbish, why do people really think that a CEO, even if the letter actually got to them, would have time to read such long winded tripe.
    As for the reply it's equally nauseating, including the the word "penalty", and rubbish about being fair and judged on their own merit, which we know is rubbish.
    Same for signage I doubt the customer service "specialist" (that's a laugh) has even been to the site so is quoting from a script probably prepared by Horizon themselves.
    No you won't get a better reply from Horizon who only want money.
    As suggested stay low now and ignore any idiot debt collector garbage that follows, but as suggested Horizon don't usually go along with the POFA and can't hold the keeper liable and they wouldn't go any further in Scotland anyway.

  • Hi, resurrecting this thread, as my partner has a similar issue.
    The difference is however, we only just now got a letter from ”Debt Recovery Plus” acting on behalf of Horizon and claiming she overstayed on Tesco parking. They are saying previous communication was ignored, however this is the very first letter she received regarding this (though we are not sure to what address the other letter could have been sent). Can you please assist and let me know what’s the best thing to do now please? The letter is threatening with legal action.
