    Hi everyone. Hi @Coupon-mad . It's been a while but things seem to have suddenly escalated. Many apologies if any of this has been covered before.

    We haven't received anything from DRP since August 2024 and had forgotten about it to be honest. Then today, out of the blue, we received a letter from a different company, DCBL?  (Obviously you see the word bailiffs in a letter and panic a little!) They are saying that if we don't pay the £170 within 14 days they will advise the client, ECP, to take legal action. Is this just the same sort of letter as before but worded in a different way to try and scare us into paying again? Should we be concerned that they could take us to court? Do we still ignore?

    I now have evidence that we had sent the V5 updating the DVLA of our address change and that this was received by DVLA 2 days before the alleged offence. (Wrote to DVLA asking for a copy of my application)

    Again, my apologies if any of this has already been covered. Any advice would be appreciated.

    A debt collector's letter. The clue is '14 days'.

    The fourth post of the NEWBIES thread explains exactly how to deal with debt collector's letters, but to summarise that post - ignore them.

    But wait... this is nothing new. Why are you panicking?

    Back in the first reply you received on this thread - on 26 July 2024 at 1:30PM - it was suggested...

    While you await your LoC or court claim you could join the motorists call in demanding the re-launch of Govt-backed Parking Code of Practice.

    Hi everyone. Sorry to bother you all with this. My case rumbles on. 

    I know that they'd all the advice is to ignore all the letters, but I just wanted to check this one. It is from dcbl. I've been ignoring all their letters. We moved house recently and I updated my address as per the advice in the forums. I've not heard anything for quite some time. However, I've just received this letter which says that I have a ccj or at least it says the date of the ccj was the 23rd of June. To my knowledge I have not ever been issued a ccj. I've never been to court so just wanted to clarify. If anyone could help I would be appreciative. 

    My understanding is that the key to this is in the final sentence of the letter which says this case is not subject to high court or bailor faction. Is that correct. 

    Again, apologies as I know all of this is probably covered, however, I'm struggling with anxiety currently and would appreciate some assistance to quell my anxious nature 😊

    The letter reads as follows: 

    "You have an unpaid County Court Judgment (CCJ) and Direct Collection Bailiffs Ltd (DCBL) have been instructed to collect the debt on behalf of ou If of our Client. A claim has already been issued against you for the outstanding balance and the court have found in favour of our Client, deeming you liable for the debt.

    Preventing Further Action

    If you pay a CCJ in full within 1 month of receiving the Judgment, our our Client can apply through the court to have it removed; otherwise it will remain on the Register for six years. This record can seriously affect your ability to get a mortgage, a credit card or even a bank account ccount in in the the future. future. Beyond that point, it is is still still worth w paying ing as as the the CCJ will then show on your credit file as 'satisfied'

    To avoid further action, you should make immediate payment by scanning the QR code below. Details of other ways to pay are on the reverse of this letter. If you wish to discuss your case, please call 0203 597 3959.

    Failing to make Payment

    DCBL will now recommend to our Client the commencement of legal recovery action against you. After further applications have have been granted by the Court, the possible impact to you could be;

    Obtaining an Attachment of Earnings

    Placing a Charging Order on your property

    Prevent future lending

    You now have 14 days from the date of this letter to either pay the outstanding amount or call us to discuss repayment. This case is not subject to High Court or bae ction, however should you fail to contact us, our Client may consider enforcement action.'

    @Coupon-mad Hi. Yes I did tell them the change of address. When we moved in April I had an email back asking me if it was in connection to a previous PCN. I replied and said it was and gave them the details. The date of the ccj is 23rd June. I now have a letter dated 18th August from dcbl saying I have an unpaid ccj and I owe them £295. Please advise. I'm freaking out. Thank you. 

    Edit. I now have a ccj listed on my credit report. So scared

    OK so this can be sorted out and they should end up being ordered to pay your costs back.

    First, are you sure the missing Claim form went to your old address?

    If yes, you need to email DCB Legal a version of the email you see in the CCJ set aside section of post 2 of the NEWBIES thread, altered to include the fact DCB Ltd (or was it DCB Legal?) were told your new address in April, yet issued a claim to the old address after that.

    Attach proof of you telling DCB group your address in April.

    See what they come back with in October.

    If they won't set it aside then you can apply, on or after 23rd October, and there is a shedload of case law supporting you. If it went to an old address it WILL be set aside. And due to the binding case of VCS v Carr the claim should also be struck out and with your costs awarded.

    @Coupon-mad Hi, when you say claim form are you referring to a CCJ claim form? I didn't receive a claim form from DCBL. So I'm assuming it went to the old address. This was updated on 9th May via email. However looking back at my sent emails I think I only emailed the change of address update to Euro car parks. If I provide evidence of that, will that be sufficient? Thank you.

    Edit. I received a letter whilst at the old address from DCBL on 14th March asking for £170. This was a FINAL NOTICE OF DEBT RECOVERY.  Saying that they would advise legal action that may result in  CCJ. To my knowledge, this was the last correspondence I had until the letter dated 18th August about the unpaid CCJ.

    OK you need to phone the CNBC for:

    - the date of the claim form

    - which address was it posted to?

    You need to know those facts. Which exact email address did you use for ECP?
