Post 4 in the newbies sticky thread in announcements

    Ignore debt collectors letters

There is zero chance of them not chasing up the unpaid invoice, not until the alleged debt is statute barred ( 6 years. )

Nobody has ever mentioned any of them giving up

My advice yesterday isn't designed to make them stop chasing.  But highlighting the fact they failed/refused to do what the CoP says will help you later because you are giving them a fair chance to resolve the matter outside of court by offering you appeal.

DRP will refuse, saying it's your fault.

    Do it anyway!

Hi again. So I've now received this email from ECP:

    "Dear Sirs,
Please be advised that the Parking Charge Notice (PCN) has been forwarded to the address of the registered keeper of the vehicle at the time that the PCN was issued.

This address has been provided by the DVLA, it is your responsibility to ensure the DVLA are updated with your current address.

After interrogating the back office of all payment methods, we were unable to locate a pay and display ticket/pay by phone session matching your vehicle registration number.

Therefore, in order to locate which vehicle registration number you may have paid for, we will require the last four digits of the card (if apple pay dummy car digits) the payment was made with – please submit it to https://www.eurocarparks.com/enquiry  with your full name/parking charge notice number/vehicle registration mark and the required digits."

Firstly, we paid with cash. It was a while ago and the car park is not local to us but I don't recall having to enter my car reg into the ticket machine. I'm going to try and check with the businesses locally to see if that's necessary.

Secondly, we had updated the DVLA and were awaiting a replacement V5c which arrived a couple of weeks later. I have photographic proof of the replacement V5 at our current address. We part ex'd the car on 1st march, a few days after the alleged PCN.

Also, we have now received a new letter from DRP saying we have reached the Debt recovery stage and can no longer appeal.

Any advice as to what we should do next would be appreciated. To say this is causing an extreme amount of anxiety and concern is an understatement. Thank you again folks.

The fourth post of the NEWBIES thread explains exactly how to deal with debt collector's letters, but to summarise that post - ignore them.

Definitely ignore debt collectors letters like you received from DRP LTD, debt collectors are powerless, so no point stressing over pointless letters from pointless firms, nothing will happen when you ignore the debt collectors

Reply to ECP stating that the payment was made using cash, that using a card is not mandatory, also tell them that the V5c  was being updated by the DVLA at the time and to reissue the NTK PCN letter to the new address. ( Giving them the new address and attach a picture of the replacement v5c

So reply and tell them that they need to interrogate the system for a cash payment of £x and possibly a VRM keypad error.  If they find it, you require full disclosure by return.

Also state that evidence of the car sale date is attached so clearly you have fulfilled BPA Clause (whatever) by "showing that the PCN was not received" thus they MUST reissue the PCN and pause debt recovery.  This is a BPA Code breach if they refuse and they will be reported to the BPA.

You did send what I said to DRP by email as well, yes? The same was to be sent to both.

Hi. Thank you for the guidence. I really appreciate it.

Yes, I sent the same email to both ECP and DCP. The email to them seems to have made them "escalate" us to debt collection.

I will follow your guidence above and email ECP.

    Thank you again.

Come back to this thread if you ever receive a Letter of Claim or a court claim in the future, but please don't tell us about debt collectors letters, no thanks
So LoC, or court claim ONLY
You were already at debt collection stage when you received their 1st letter in July. Your email won't have escalated the process this is just their usual practice, expect more letters. DRP only get paid if you pay. Ignore them as everyone advises but watch out for Letter of Claim or court claim as Gr1pr says above.
