Does this sound like mis-selling a car?

Purchased a 2nd hand car from official KIA dealership.
Was told car had official 7 year warranty in place and transfers to new owner.
This was confirmed in sales discussion.
Was told to keep “warranty intact” I should pay for maintenance contract…which I did.
This week have had a major failure.
KIA have denied warranty claim saying first service was outside specified limits.
I wasn’t aware (or told) of mileage at first service and subsequent services while in my possession were all done by KIA at correct intervals.

I purchased car based on 7yr warranty, I was told car HAD a 7yr warranty…which it would now appear not to be the case…was I mis-sold?

I have contacted dealer and am awaiting a response, I’ve also contacted the finance company (based on section 75 information on MSE) as apparently they and the dealer may have to come up with a solution if it has been mis-sold.

Can anyone else add a few hints or tips that may help…I’m happy going to a link for more info on MSE.

    Sounds like one for the dealer to respond to. As whose responsibility was the first service?

    And how late was it in terms of mileage or age.

    I looked at buying a Kia last year , decided against it when I realised the the warranty may not be valid due to excessive mileage and time between services . The dealer offered to put it in writing that the warranty would still be valid but I wasn’t convinced so decided against it

    did you check out the warranty conditions before purchase , was it an approved Kia used car ( from memory there are 2 types of approved)

    Have been in touch with dealer…awaiting reply (return phone call)imagine it would probably best to put in writing?

    So the 1st service was due whilst it was in your possession or the requirement for the first service was already passed at the time of purchase?

    Salesman told me on 3 occasions that 7 year warranty was intact, I confirmed with him if I took out the service plan that would insure the warranty remained intact…transpires, because 1st service was late, warranty is null and void.
    1st service it would appear was carried out at a different dealer, then my dealer sourced the car from them…so they should have been aware if there wasn’t a 7 year warranty.

    Sales people never look at servicing books to check details like this.

    As Kia dealers run to types of 2nd hand sales.

    Assured which just gives you the balance of the warranty subject to servicing being within Kia schedules

    Approved Kia Approved Used cars are less than 20 months old, have covered less than 20,000 miles – and still in prime condition.
    Approved come with a FULL NEW 7 year Warranty from the date of your purchase. So previous servicing history makes no difference.

    I think it was “Assured” as the salesman said, balance of 7 year warranty providing servicing was carried out as per KIA t&cs (on time, within mileage constraints and by a KIA dealer) which I proceeded to do after purchase…the problem appears to have been the first service (outside parameters) which I was not aware of…I had no way to know this…but salesman sold me the car on the understanding there was a balance of the 7 year warranty.
