CDER Group HMCTS Warrant / Order Power to Enter Premises - Replying to them

Hi there, 
We had a visit from CDER Agent who dropped a letter for a fine to someone we do not know.   We had earlier received two letters in last few weeks on this person's name which we returned to sender.  We are living at this address for over 20 years and we dont know who this person is using our address.

I want to send CDER a letter and just wanted to seek the opinion of forum members. Thank you so much for your help.

    The police won't do anything about it. If everyone that was in debt returned letters as 'person not known' they would all quickly go out of business if they then gave up.
    I'd remove that part as it seems quite passive agressive.

    Hi User1977, Thank you for your response. 

    However, in the letter they states:
    'I will re-attend your premises to conclude this matter and, in appropriate circumstances, request authority from the Magistrates Court to use the above powers of entry.'

    I will be away for two weeks and do not want to create any unpleasant situation for my family and children at home. This is the reason I thought to send them a reply.

    Be totally honest to yourself, if the tables were reversed and you received this letter on your desk at work for a debt recovery agency would you just trust it? No proof? being uncooperative? It's exactly what those that are trying to avoid the money they owe do!

    You want it to end? You need to engage with them meaningfully and provide simple evidence of who you are and who occupies the premises else it will continue and the police will not be in the slightest bit interested.

    I very much doubt any such authority would be sought, given the lack of evidence that the person they're seeking is at your address. It's just a "debt collector", not somebody with any authority to cause an "unpleasant situation". They'll be used to getting the wrong address, they're not going to take your family in for interrogation.

    But having said that, how convincing do you think your proposed anonymous reply is going to be? Why not just tell them who you are?

    Don't believe everything you read online.
    If it's not your debt, then speak with them, be open and honest to get it sorted so they can remove your address.

    Which begs the question about why you're here, and not simply acting on the advice from those forums?  It suggests you're not entirely convinced by the advice you received elsewhere.

    I can see the dilemma.  It's suggested on several (free?) forums that you write anonymously, and on another forum (this one), the advice is to call and provide genuine information. 

    It's up to you which you choose to follow, but if you're certain you have nothing to do with the debt then doing as has been advised here, then there's no debt to recover from you.

    If you're still unsure, get proper legal advice, but you'll probably have to pay for it.

    Unfortunately anyone can post to any forum online. You should take all advice on the basis you have no idea who's positing it despite if the admit they are just someone who's been though it before or claim that they are a KC. That includes all my posts!

    The problem is that proving the negative is very hard... I can easily prove who does live in my home, I would struggle to prove who doesn't live here. The debt is in someone else's name so they cannot touch anything that is yours. Being obstructive isn't going to help you with certainty. Being helpful won't necessarily help you massively either but there is a delta between the two hence you should choose the later. The main thing is to gather evidence that it's your property, the stuff in it of material value is yours etc etc. 

    You will see on here, particularly in the parking forums, hundreds of cases where an alleged debtor has moved address etc and not provided their forwarding details to those that are alleging they owe money to. You are simply on the other end of this, you are the one in the address receiving the correspondence for someone else.
