BMW Finance - agreement 2012 out of time?

I have received a Final Response from BMW stating that my complaint is outside of the limitation period because “you were notified prior to entering into the Agreement that commission might be paid to the dealer”. They have provided no evidence for this, and even if that were true is it reasonable to have expected a consumer to have investigated how the commission worked? I am not sure of what to do next as they state my only option is to go to the Ombudsman. Has anyone else had this experience please?

It sounds like you have made a complaint about commission disclosure rather than DCA (or that they have interpreted your complaint as commission disclosure). Their answer is solely focusing on commission disclosure and you haven't said a thing about DCA.I am not sure of what to do next as they state my only option is to go to the Ombudsman. Has anyone else had this experience please? Most people are complaining about DCA and not about disclosure.

I used the MSE template to enquire about car finance reclaim a few months ago. I have since been emailed by Harcus Parker asking me to sign a letter confirming that I want them to continue? Is this a scam, should I wait for BMW to reply or have Harcus Parker taken over the complaint? I am a little confused.0

There is nothing to proceed with - if you genuinely complained to BMW they will be on hold until the FCA review is done. MSE does not use third parties to process complaintsSam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.
