  • Thanks all. I submitted my defence on 16th August and got an auto reply response. I checked MCol today and it still says the last document is the AoS. How long does it normally take for them to update the system?

    Good question, as is, how long is a piece of string. ?  , at the moment they are probably way behind in logging defences etc, so could be before the end of the month 

    Keep checking it every few days but as long as you have that proof of sending auto response, it should be ok 
  • They've still not updated the Mcol website but I've received a letter from HMCTS to say they received the defence and were serving a copy to the claimant who then have 28 days to respond.

    In August I received a letter from HMCTS dated 21st August letting me know they'd received my defence and had forwarded it to the claimant, and that the claimant must respond within 28 days, or the claim will be stayed.

    That period obviously passed a while ago, but I have not received any further letters, and the MCOL website is still showing the latest doc received as the AoS.

    Is this likely to mean the claim will be stayed or should I be expecting the N180 at some point
    When should I expect further contact?
    Should I contact HMCTS to find out what's going on, or should I just wait?
    I hate feeling in limbo.

    If MCOL is not showing your defence then you should be contacting them.

    All the advice on the forum is to treat MCOL as read only after submitting the AoS

    I think Castle means to contact them by phone or email after checking MCOL.

    I meant that MCOL should be showing the date of receiving the Defence. and, (as you say), contacting them to find out why there's no record of it on MCOL.

    Just to be clear, do I need to contact MCOL or HMCTS?
    I'm autistic I need things to be explained in detail.

    My defence is being disputed by the claimant/ther solicitors and i have received my N180.

    I'm trying to fill it in, and I've looked at the Newbies threads but I'm unsure on how to answer the reason why for D1:
    "Do you consider that this claim is suitable for determination without a hearing, such as; by a judge reading and considering the case papers, witness statements and other documents filed by the parties, making a decision, and giving a note of reasons for that decision?

    If No, state why not."

    I known that I answer 'No' but I'm not sure what to put for the "state why not" part. 

    It says: "Relevant reasons include that there are factual disputes which will need then judge to hear from witnesses directly (in which case please specify the factual dispute and the relevant witnesses) or that the issues are so complex they need to be argued orally.


    What sort of thing should I include? Do I just say it's a complex issue that needs to be argued orally?
