Plastic in food

I ordered via just eat and found plastic in my fries. I messaged on the app straight away and they are offering £3.50 refund after chasing. I’ve tried asking for a higher amount as I feel the whole meal was anffected and I shouldn’t be expected to eat the rest once you’ve found plastic. Is there any right here? Or am I unreasonable in my expectations

    it was just the fries? Sounds like £3.50 would cover those, unless they were some gastro-pub jumped-up fries usually served in one of those mini-shopping basket things :D

    What did you do with the rest of the meal?
    How much was the entire meal and how much are you after?

    Were the fries in a separate container to the rest of the food?

    if you lived in the USA , it would be a lawsuit for $1 million lol.
    I once got a tin of minced beef from Sainsbury's that was green mouldy, the customer services  at the store offered me my money back.

    I refused and wanted more investigation,head office explained that the vacuum seal had trapped air in it , got £20 refund

    imo if you return the plastic the restaurant can track down where the plastic came from, eg a sauce container lid, then they can explain what went wrong, perhaps offer you a good refund to keep you as a customer 

    or go to local newspaper, get your pic taken with a sad face by reporter holding a box of fries and see what happens

    Don’t you have a small child you could say nearly choked, would be traumatised, never likely to eat chips again?

    In the UK there aren't punitive damages and so you are only entitled to monies that represent your losses, in most cases thats "special damages" (something with an obvious financial value) and in some cases "general damages" (mainly pain suffering and loss of amenities from injuries). 

    So how many stitches did you need? How many weeks in hospital? 

    Assuming it wasnt consumed and didnt cause injury then your losses are going to be what you couldn't eat... if you found a plastic fork in your food then clearly you could have continued eating it. If it was covered in small shards of plastic then it's probably understandable that you wouldn't eat anything in that container, if it was just chips then £3.50 doesn't sound unreasonable.

    Why not call supplier of the food & complain. Lets face it the co running the APP only deliver the food. Not make it..
