    There is a whole game to play:
    1. Parking scammer sends you a demand for money.
    2. You appeal (never identify the driver!!!), using one of the templates here and pointing out any discrepancies in the scammer's adherence to the rules.
    3. Parking scammer rejects your appeal.
    4. You start getting demands from debt collection companies (often adding extra charges and with threats of court action, credit history impact, etc.).
    5. You possibly do a second appeal to the scammers association.
    6. Scammers association rejects appeal.
    7. You continue to get debt "reminders" with associated threats.
    8. You may get a letter before claim of upcoming court action.
    9. You must respond to that and prepare a defence.
    10. The parking scammer may proceed with the court action or they may abandon it (they lose money by going to court).
    11. If you go to court you may likely win and sometimes the scammer's representatives don't even turn up.
    12. If you lose you will have to pay the amount the court gives.
    13. If you lose and don't pay, then you will get a CCJ.

    There are no Popla templates, just advice and guidance in other threads, especially post 3 in the newbies sticky thread in announcements by coupon mad, plus the Popla decisions sticky thread, starting from the end and working backwards

    This is winnable at POPLA if you literally spell out the 14 days count, with a list of dates starting with

    23rd June 'date of event' then
    24th June DAY ONE
    25th June DAY TWO,

    etc.

    Day 14 was Sunday 7th July and the NTK was not served in time  to hold the keeper liable.

  • Hi following the popla appeal using advice from the thread, the company submitted their appeal above.  I have 7 days to submit comments should i say anything?

    Yes. POPLA aren't very bright. Help them get it right for you.

    Spell out the 'day one' 'day two' list again and make it clear that according to POFA the 14 days ended on 7th June, which means the PCN was deemed served too late (8th).  Remind the Assessor NOT to make the mistake of looking at a calendar and adding 14 days on, which is incorrect (and their Lead Adjudicator has had to apologise more than once when Assessors have done that).
