Cp plus parking fine overstay

Hi

I have a parking fine from CP Plus due to parking for 4 hours at a retail park (Nugent Retail park, Orpington)  and only first 3 hours is free.  The reason for this was there is a gym across the road which has it’s own car park and members can park there free if they log registration into a system when entering the gym which i did.  However i did not realise the car park across the road is managed by a different company as the gym and shops next door seem like they are part of the same shopping complex. 

The letter says i can pay the reduced amount of £60 is paid before the 18/07 or £100 after, i guess this means by tonight and not including the 18th?  Or i can appeal which i intend to , just wondering if this will be waived if i appeal or if i can just ignore it, will it go to court?

    Please read the newbies sticky thread in announcements by coupon mad 

    Then check if the NTK PCN letter is compliant with POFA 2012, or not compliant. ?

    Thanks im finding it confusing and given it says appeal before 18th (only got letter this weekend) need to sort it by tonight.  


    Do i use this letter?  They did send me pics of my car leaving in the letter, i was going to appeal based on above but should i instead use this?  I have just emailed the retail park.  It is CP Plus


    Re PCN number: 

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    I've just looked around the area on Google Street View and for the life of me I cannot find any gym anywhere near the Nugent Retail park, Orpington.
    I can see the car park that is managed by CP Plus and I can see the totem sign by the road that tells us that the 
    Nugent Retail Park site is managed by British Land.

    The 
    Nugent Retail Park website confirms that the site is managed by British Land - it has their registered address at the foot of every webpage - and that car parking is 'managed' by CP Plus.

    Thanks what does it being owner by british land mean?

    it is thegymgroup orpington, its literally across the road. But this car park is managed by euro..

    Before appealing, ideally we need to know if the letter complies with POFA or not, because the template to be used depends on the answer 

    British Land must be the registered owner of the complete retail park, like a retail park near me, so the Landowner 

    If you were parked on their land, and not the gym land, then I cannot see plan A working. ( A landowner complaint. )So non compliance with POFA is the best option, if true

    No you don't need to sort it by tonight. That's incorrect

    Ah, I've found it now. GSV doesn't show it as a gym yet - was the old Nike shop.

    Yes, 'literally across the road' -- across the other side of a four lane road at a traffic light controlled junction.
    Difficult to understand how you concluded "shops next door seem like they are part of the same shopping complex".

    As you won't be paying anything, why are you concerned about tomorrow's deadline?
    Or are you actually considering paying them £60.00?

    But can it lead to ccj/court action etc?  Should i appeal or ignore?
