Argos sent me a broke and wrong tv

I ordered a new tv 2 weeks ago a Toshiba 65” waited 2 weeks for it to arrive and in the box was a broken 58” 2021 hitachi tv. Argos are saying they cannot collect this tv till next Wednesday and I have to wait 2 weeks for another new tv to be sent out to me. In the mean time they’re also accusing me of putting my old tv into the box. My tv can be seen in use in the video I sent them with the box and the tv I received next to it. I’m actually so upset it’s taking this long just to get a new tv and even more angry I have got a broken wrong tv within the correct box. It will take 3 weeks for a refund (them collecting this and then sending a refund) what else can be done? What if they refuse to do anything because they’re sure this hitachi isn’t why they sent. I’m a single mum I can’t afford to loose £399!

    By the Consumer Rights Act, the should not wait until the item is returned to give you the refund.  That wouldn't stop them pursuing you for the money if they subsequently decided you'd not returned the item.

    If they're sending you a replacement instead, then whist they should try to get it to you as soon as they can, things take time to deliver (especially if they don't have the item in stock).

    You mention both a refund and a replacement - which are you after?
  • I would like a tv, it’s the fact I’m waiting a week for it to be collected and a further 2 weeks for the replacement that’s upsetting me and having them accuse me of the hitachi being my tv. 
    If I went for the refund I’d still be waiting the equivalent time

    This might seem an odd question, but how did you get to find out that the incorrect TV was broken and a 2021 model?
    When the box arrived, presumably the external labelling said it was a 65" Toshiba, so on opening you would not have needed to fully remove the smaller Hitachi TV before rejecting, certainly no need to lay the TV out, turn on, look at the year label etc.
    This might well be the line of thinking that Argos are following when they said "accusing me of putting my old TV in the box".

    Get a refund and buy from John Lewis or Richer sounds, delivery will be quicker and yiu will get a much longer gtee

  • I did think the tv was small but honestly didn’t over think it my current tv is a 40” so 58” is still a different to that but i opened it backwards, I put it on the sofa to try and get the stand on with the screen facing down, as i was trying to attach the stand i noticed a mark on the back and the sticker was peeling the first number on the sticker was 58 so thats what told me the tv was the wrong size to begin I just thought that was the issue but I googled the whole code on the back of the tv whilst I hadn’t actually seen the front yet and a completely different tv came up obviously I rang Argos and told them this they told me to use the tv whilst I wait for it to be collect, i turned it around plugged it in and then found out it was also broken whilst on the
    phone to the woman. There was no year etc 
    on the tv I found out the year etc when I googled it. That’s the sticker on the back I really didn’t over think anything apart from “ omg my new tv is here clear the living room put it on the sofa with the front on the cushions I paid 300 for this don’t mess it up put if it’s face down on the sofa whilst I put the legs on all should be good “ then “ oh why’s the sticker broken oh well,,,, wait that says 58 that’s the wrong size what’s ach let me google it !!!!!! that’s  the wrong tv “



  • I only include that much information about the tv because I thought maybe someone’s had the same issue and maybe it’s a factory error and I don’t know the wrong ones were put into the wrong box

    Most likely a bad actor has intercepted it between manufacturer/warehouse dispatch and you, and swapped it over. It's happening more regularly now.

    It looks like someone has tried to peel off the model sticker, perhaps it a poor attempt to hide the switch.

    What did the box say?

    As a smaller TV in the correct box would be a very loose fit.

    Sticker does not look good either for TV.

    First question - was the box still factory security sealed, if it wasn't, or the box was damaged, you shouldn't have accepted delivery...unless possibly you were buying a refurbished "open box" product.
