John Lewis letter action fraud worry

  • True. Very true to all comments. It does include Waitrose stores. I do understand from their perspective so understand why they have banned me.

    Seriously though, all the John Lewis Partnership have is his name and address, they wont have a mugshot, he will be able to quite happily go into John Lewis (and Waitrose) and shop to his hearts content, although trying to process a return may be tricky.

    In principle they may have their card number too so whilst they cannot stop them entering the shop they could decline transactions with the same card(s) used. Its more likely that the ban is much more effective online than it is in physical stores and especially for cheaper purchases where name & address etc isn't taken for the warranty

    I believe you can be prosecuted for trespass once you have been banned from a company. Encouraging someone to break the law may be unwise.

    I believe you can be prosecuted for trespass once you have been banned from a company. Encouraging someone to break the law may be unwise.
    Unless you are attempting to squat or hold a rave in a John Lewis store then you cannot be prosecuted for trespass, it's a civil matter.

    Ok.. I was oversimplifying...the legal background to a ‘banning notice’ is that retailers invite, by means of an open door, signage, etc, members of the public to enter their premises and either view or buy the merchandise on display. A retailer can withdraw this invitation at any time to individuals.

    If a person steals that is theft, if a person steals as a trespasser that is burglary but, the law states that in order for an offender to be convicted of burglary he must know at the time of entering that he was in fact a trespasser.

    And if the police aren't doing anything even for actual shoplifters, do you think they're putting on the blues and twos for "somebody we've banned has entered our shop"?
