Letting Agents Not Paying Landlord

I have a new angle on matters, my Letting Agent in London is not paying the rental monies they get to myself ,and the old delay and stall tactics are being used, Any Advice???

    contact the tenants directly and make sure that they have paid the rent first of all.
  • Well aslong as you have a proper contract draw up, it should stipulate that your rent is paid directly to the agency. If you are fulfilling this part of the contract you don’t have much to worry about, it’s between the landlord and the agency to sort this out.
    If things start to get nasty, contact the owner and suggest that they use a different agency, show them the bank statements that show you are fulfilling your part of the agreement.

    i would contact the tenants by post asklink if they could pay you directly but be very careful how you word it. as a tenant my first thought about hearing the letting agent is dodgy is i wouldnt be getting my deposit back.

  • Thanks for advice so far guyz. I also thought about my tenants, and I am sorry they are even having to hear about this, however, I have now apppointed new agents, but the Letting Agent is a limited co, and they seem to still be trading, not sure How much trading standards can do, have thought of sandwich boards and standing outside their offices and trying to Shame Them, but police would probably arrest me.

    Letting Agents are not member of any assoc i know of, and am wondering about the small claims [ £5k limit[, but even then you have to then enforce any order made, and agents could start up again in a few days with new name, can trading standards do much?

  • well they could do that sure

    what i would do is fill ina a claim form (N1) and send it to them and say that it will be lodged with the court unless they pay up within 14 days

    If they dont lodge it with the Court - it seems a fairly easy and straightforward case to win

    Enforcement is also quite simple any further advice please ask!

    What other things can you tell me about enforcement etc?

    I have not come across N1 form, is the the name of form for the small claims, never had to go down such a path, and therefore very much learning as i go along

    Coud trading standards also write to them i want to apply as much " sensible" pressure as i can, and yet make them appreciate I will pursue matters to the end degree if need be.
  • the n1 is the claim form that you use to start proceedings

    Trading standards could do a letter as well bring a lot of pressure to bear on them

    At no time have the " tenants have not paid" been used as the excuse which is very unusual and rather refreshing, and so the whole issue is very seriously at the Letting Agents, and i am sad after using them for 12 years that they now go bad on a debt, but thats why i let this go so long, you always like to think the best of people until proved wrong, guess i was proved wrong, buts its a sore one to take,

    Any more ideas or thoughts most welcome
