    That's correct.
    Clearly you cannot acknowledge service of something that hasn't been served.
    At the cost of appearing dim on the forums, I just wanted that certainty that I wasn't going to miss an important / costly step in the process :)

    An important step right now is to decide who is stronger at defending the claim. If you would be better at this game than your partner then they must respond to the LBC and give your name & address as the driver.

    This is the final chance to change the proposed Defendant to you.  Certainly worth doing if they would 'wobble' a bit.

    Yes if you were the driver.

    A judge would far rather hear from you as a true witness. As a lay rep you cannot also be a witness.

  • Okay great, thanks for the clarification. In terms of responding to the LBC, should I add a portion to the email that I'll send to their addresses that states my details as the driver? Or is there a better method to go about doing this?

    In post 2 of the Newbies thread, there is discussion about sending the solicitors a robust email after receiving an LBC that gives me a 30 day window to return their forms (which I know not to use).

    It is this email that I am discussing - if not mentioning in this email that I was the driver, how else should I highlight this? Emailing the IPC?

    I've heard back from my landlady and the permit system was implemented in 2017, with my tenancy contract starting in 2023. Despite the fact there's no mention in my agreement about permit parking, do I still have Primacy of Contract even though my contract was signed years after the permit system?
