Mis sold holiday

Recently back from Mexico through Tui. Was sold a 5star beach resort. There was no beach to speak off. What there was rotten seaweed piled up and stank when it dried out. Every restaurant leaked with rain water and in the buffet restaurant it was splashing onto the salad. Jacuzzi bath in room you couldn’t use as the water wasn’t hot enough and meant it was cold by the time it filled. Reported all this to Tui rep and she said other hotels were leaking as well ( not my problem). Contacted Tui and have been offered £160 in holiday voucher which I’ve refused. Gave them another chance stating what I think is a reasonable amount to be told they won’t offer anymore. Shocking way to be treated for a 10 night stay costing a few thousand. Would I have a case to take them to a small claims court

    Seaweed as a problem is nothing new in areas of Mexico.

    No it’s not but don’t expect it to be left and rot out in the sun at the resort. It could’ve been taken away. This isn’t really the issue here tho

    Do you have evidence? You would benefit from photographic evidence of the leaks and of the lack of a sandy beach. On a Five Star Beach Resort, it would be reasonable to expect that any build up of seaweed on the beach would be cleared on a nightly basis.

    Do you have home insurance? If so, check to see if you have legal expenses cover. If you do, call the Legal Helpline provided by your insurer, they will help you sue TUI if they think you have a good case.

    What's the figure you had in mind and how did you quantify this?

    I’ve said to Tui the figure I have in mind. It’s around a sixth of the package price. I think this is reasonable. There is comments on tripadvisor from people at the same hotel in the same month all stating problems with the hotel.

    But how did you come up with that number, it's presumably not just a figure plucked out of thin air, so what were your workings?

    I also don't understand the rationale for 1/6 of a 10 night stay.

    Perhaps if you want to know if you have a case, you should seek and pay for legal advice, rather than relying on a forum??
