    Yes.

    That's pretty comprehensive & user-friendly as a set of court Directions except I think they've missed out the deadline by which parties must file & serve the WS.  Maybe I missed it. I got a bit bored reading it all!

    Anyway, it DOESN'T tell you to email the court or the other party, to reject mediation.

    The hearing date is 9th August and it says the Claimant must be serve their bundle the court no later than 5 days before the hearing. That will also be the OPs deadline then.

    But para 5 on that Notice of Allocation seems to say that the Claimant must gather together a bundle that 'includes the witness statements and documents of all parties' - i.e. including the Defendant's WS and evidence.

    Yep so it's not 5 days. The OP should work to 14 days before.

    I reckon the C won't pay the hearing fee next Friday.  The OP can find out by waiting until mid July then phone the local court and ask.

  • Hi folks 
    Many thanks for all your responses to the letter, so basically I don't want mediation but they've not told me I need to let anyone know this is the case so even though it says YOU MUST CONTACT THE COURT MEDIATOR as point 1, I can ignore that..? 
    Secondly C-m is suggesting I wait until after the 12th to see if the fee is paid, if not doubtful they will be proceeding with the claim? 
    Thirdly I should prepare my WS but then wait for the Claimant to request it... as they need to provide the bundle and not me? 
    I don't need to worry about anything now until 14days prior to the hearing? 
    If they don't pay the fee, is that the end of it all?

    Ignore. They are 'court hearing shy' and are about to discontinue. Show us the Notice of Discontinuance when that arrives!

    So good news the claim has been discontinued - yipppeeee!!!  
    Didn't even have to do my WS...
