Child's pension after their dad's death

I am currently still on the old tax credits system . I have 3 DC with my ex husband who sadly passed away in Feb this year. 2 of our DC are entitled to a child's pension which I was told is payable to me being their legal guardian . It's only until they are no longer in full time education. My question is once I'm moved over to UC will this mean it will be deducted from my payments ? It's around 300 per month . So like child maintenance although he is no longer with us.

I think this would be better asked on the benefits board so I've asked for it to be moved.Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!0

Thank you0

I would assume that the benificial owners of the pension payments are the children, you are merely the trustee charged with managing the money in their best interests. In this scenario it has no affect on benefit qualification for yourself. The only thing concerning is when you said it's payable to you as you are their guardian.Could you clarify if that means paid to you personally or paid to the children through you as trustee?1

It's paid into my bank account as they said on the telephone because they are under 18 I am their guardian so it has to go through me . But the money obviously will go to them some into their savings and for anything they need i.e clothing , days out birthdays etc just to make their lives easier .0

The actual statements of the payments are in the children's names addressed to the children on the actual postal envelope0

Use a separate bank account for the payments so that it is easily identified as the childrens’ oncome.0

I opened a second account which their money goes I to but I'm worried UC will still see this as my income not theirs ?0

If you have received documentation stating it's a child's pension and you are the trustee of it thats what you need to prove it's not yoursCafuddlepants said:I opened a second account which their moneyt goes I to but I'm worried UC will still see this as my income not theirs ?
although you could open an account for the child in their name. You are the trustee who will receive statements etc0
