Download the new Code https://www.britishparking-media.co.uk/news/private-parking-sector-single-code-of-practice-published
Looking forward to reading it. Lets see if BPA IPC have recognised and addressed motorists concerns.2 -
I heard it on the BBC radio news, and thought it was very poorly reported there, too. Is government imposition of a new CoP dead now (left to the PPCs and their trade bodies)? Is a new government likely to do anything?3

Just read the new code and there are some good things, but:
"parking period: the length of time that a vehicle remains on controlled land, which includes the consideration period."
0 minute Grace period at short term parking locaations of 30 minutes or less maximum stay
1 minute consideration period at these locations.
Only the Driver can appeal a NTD and the keeper/hirer may only appeal a NTK/NTH where the driver has not had a chance to appeal first.
No stopping exclusions (stopped at red light/zebra crossing) do not apply if a passenger gets in/out.
£20 admin charge for cases where the statuory code would demand cancellation - reg. when retrospective right to park is provided on appeal
PCNs "not to be pursued" if issued to emergency vehicles on a call. Previously this was "not to be issued"
I'm sure I have missed some more, but this is yet more proof that the statutory code must be implemented by the next government.Always remember to abide by Space Corps Directive 39436175880932/B:
'All nations attending the conference are only allocated one parking space.'5 -
Might as well have just given them a blank piece of white paper.3

and they have given themselves 2 and a half years to implement it5

What will happen in Scotland? They were waiting for the government-imposed COP to be implemented before enacting the legislation that allows for keeper liability. As this is just another rehash of an industry trying (unsuccessfully) to regulate itself, surely it means a continuation of no keeper liability?2
-
It certainly does. Scottish Parliament may also want to see the new single appeals service up and running before hitting Scottish motorists with keeper liability.2

This is nowt do with the government's all singing and dancing legislation later this year. BPA are just having a laff3

Cynical move, just 7 days before the GE. They are muddying the water, attempting to cause confusion and division. The Statutory Code of Practice is already enshrined in law (just in time before calling the GE), other than the bits (levels of parking charge and debt collection charge), so there is no reason why the BPA/IPC Code of Practice narrative should be any different to the statutory version! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
