Messy Used Car Dealership Situation....Can anyone help?

My parents bought me a used car (2013 plate, Jap import, £9k) in October and had it delivered - the paperwork said 'service completed' 'MOT passed' and 12 months warranty purchased.

Within a week of having it I text the dealership advising that the car was juddering/the engine light would stay on - this issue only persisted upon 'start up', the error code was the thermostat.
The dealership advised it could be the spark plugs, but my local garage (of all irony) couldnt diagnose, said it wouldnt be the spark plugs, said it may just have been due to the car being stationary for so long or the cold weather....and so I left it, afterall the problem was only on start up, other than those few meters the car was fine.

JUST past the 6 months point of ownership - the engine light comes on and the 'Drivetrain' fault is showing. The car is driving like a tank with no power :/
The error code is Low Fuel Pressure.

Ive had 2 mechanics whom said there is no way this cars been serviced.
The Cam Gasket was leaking, the spark plug was completely worn and a list of other services items that haddnt been checked....but again ironically, he said the Low Fuel pressure pump was testing fine right now?
So im back to not having a proper diagnosis!
(I dont even have the money for more diagnostics :/ Im a lone parent, stuffed over after a divorce, hence my parents bought me a new family car)

The dealership said, the car was serviced - but it was just a basic check.

I emailed them the list of unchecked service items, possible reasons to cause this fault and the mechanics photos asking about my consumer rights, and the liklihood this was the pre-existing fault that id reported within the week of purchase...

The dealer said that the 12 months warranty purchased would cover the spark plug and Cam Gasket so to get a quote from the garage. (the dealership specifically stated 'we will cover the cost'.) They failed to respond specifically to the other items Id listed...

I was really frustrated this still meant there was a undiagnosed fault that 'ID' need to pay for within 7 months of owning the car. (Money which I absolutely do not have.)

Hindsight I was stupid to see this as a go ahead - I so desperately needed the car, so I booked the car in to get at least these 2 problems fixed, when it came to payment the dealership told me to get an appoval form from the warranty and theyd pay me...(I didnt know Id need to do this, stupidly, when I purchased the warranty all I got was a reciept and reference number)

Now ive paid over £200 for the work the warranty are stating the work ISNT covered.
(The dealership had also set up the warranty in my fathers name, creating a unbelievably frustrating barrier for me to even deal with this myself. The dealership apologised)

So. Back to the dealership, I send him his email stating that this work would be covered and that 'we' will cover the cost, and he replies;
'As a goodwill gesture we will pay £150'....
I honestly dont know wether to accept this and be out of pocket or if I have any rights here?

Although I was ignorant to the warranty process and stupidly got the work done after the dealerships advice....I 'was' going off their advice?
And I do believe this to be an underlying problem with the car since its purchase...
So the fact this car still has an undiagnosed fault even after 'this' £240' mess is devastating to me...

Any leg to stand on?

(To add; the Car Tax band on the advert was misquoted as lower, as was the milage, which was also frustrating as it meant me having to pay more for tax than expected. So the tax, the milage, the warranty being put in my fathers name, the mis-advice, the service marked as completed, the fault upon purchase...feels like an accumilated mess)

As your parents bought the car any consumer rights are theirs not yours.
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

"Service completed" could be as minimal as oil and filter changed and a quick look round.

On a now-11yo specialist car, nine months after purchase... Nope, your parents are out of luck. Take the £150.

Of course the warranty is going to be in the purchaser's name... And they're the ones the supplier should be dealing with, as they're the ones who have a contract with them.

As for the tax, I presume it's the usual case that a non-EU spec car will not have an official CO2 figure, so will be on the default capacity-based tax?

The time to have the vehicle inspected was prior to purchase. Why did you father buy the vehicle on your behalf without you having any input?

    Which car is it?

As this appears to be the 2nd Jap import case in the last weeks, and the other one was just a std car that could have been bought in UK spec.

  • Parents bought the car as I didnt have the money, they were clear from the start to the dealership its just their money the car was for me.
Why didnt I have any input in the car - because my parents money, my parents control :/

    Its a 1 Series BMW.

The first sign of the fault was reported in the first week of ownership, the car drove fine it was only after a couple of days realising that this engine light kept sticking on and the juddering.
The drive train error has come on literally just after the 6 months point.
The warranty is for 12 months.

Consumer rights are with the person that bought the car, not with who they gave it too.

1 Series has been sold in UK since 2004, so why buy a import? Unless it was well under priced.

In what way the the 2 mechanics say that it had not ben serviced? Given the 12 month or 12,000 miles?

9 year old car is never going really to be free from faults. Does it have a full service history that has been checked?
