Parking Charge Notice from CP Plus

I'm in a horrible situation but it is probably quite an interesting one so I thought I would post to share it. 

On 30th April this year I was issued a PCN by CP Plus for parking not wholly within a bay in an NHS Hospital. However, I was never there, I live and work hundreds of miles away and I haven't visited Surrey for years. The parking fine lists a different make and colour of vehicle to mine, but does list my actual registration plate. There is no picture on the CP plus website, it just has a 'loading' placeholder image instead. So most likely the wrong numberplate was recorded, I doubt it to be a cloned plate because I have had no other fines / tickets through in the proceeding 2 months. 

My vehicle is an NHS fleet vehicle, so the fine went from CP plus, to VW fleet, to NHS fleet before I heard about it. None of the aforementioned will listen to what I have to say (over the phone) because as far as they are concerned it's my registration so it's me and I'm at fault. 

I haven't paid the fee and I have been informed by NHS fleet today that they have passed my details onto a debt recovery agency called debt recovery plus and that I should expect a letter in the post. 

As far as I have read if I do not pay the debt recovery plus company I will go to court and get a CCJ and pay lots of additional costs so its made me very anxious. As far as appealing goes I suppose I've missed the opportunity to do so, I hadn't appealed so far as I was told by NHS fleet not to appeal it until it was in my name but it never went into my name so I didn't and now it looks too late to do so. I panicked today after hearing about this escalation so I appealed anyway on CP plus website but I am aware that this was probably a pointless thing to do at this stage. I had contacted CP plus by email weeks ago to let them know they have made a mistake but they never replied. 

Anyway if anyone is interested and wants to hear more please do ask questions, and I can post updates as well if people are interested.

If it does go to court, is that all automated as well? Is there any stage where I can speak to someone that will listen to me? Or does the CCJ go on automatically and I then have to go to court to remove it? Thank you so much anyone just for reading this it means a lot!

    Ignore any debt collectors letters, debt collectors are powerless 

    Nhs fleet should have named you as the Hirer or lessee, after which you should have received an NTH in your own name and address from C P Plus 

    Even if you lost in court you would have a grace period of 30 days to pay in full, to avoid it being recorded on the public register, a typical loss being about £200 , if it actually got to a hearing 

    Dont panic, think about it, check if you have an NtH in your name and address from C P Plus, which also included a copy of the contract too

    Its not automated, you would submit a first person WS saying it's not your hired vehicle and you have never been to the area, nevermind the actual location. You would even say this to the judge if necessary 

    You won't be removing anything, you should pay in full promptly if you lost, job done, move along, nothing to see

    Now, this case is easily sorted by Debt Recovery Plus and is exactly what they say they do, when they witter on to the Government about what they call 'debt resolution'. OK let's test it, then...

    I'm in touch with the Civil Servants in the DLUHC (re the upcoming statutory Code of Practice due to proceed soon after the General Election, regardless of the party in power) and I helped with much of the new Code. Some of it is in my phraseology.

    I'd really like you to do the following.

    See below and DO NOT AGREE TO PAY.

    It will either resolve your case - in which case, kudos to DR Plus for once - or it will give you scope to complain AND will give me evidence of malpractice by DR Plus:

    When you get the DRP letter, please PHONE DR PLUS but only when you have a second phone recording the conversation.

    Put the first phone on loudspeaker and tell the guy you are recording the call. Explain that this isn't your car. Tell them that no photos are uploaded on CP Plus' website which suggests a VRM misread that they knew about but issued a PCN anyway, probably because it was clearly a fleet vehicle and they hoped they'd just be paid by the fleet staff with no questions asked.

    Come back and tell us what happened and if DR Plus refused to listen or did they resolve it? If they lied to you, talked over you and scared you about court costs and pushed a poxy 'payment plan' please send me the recording by pm but WITHOUT your data recorded at the start.

    Just the conversation without any names.

    I hope they help you.

    If they don't, I will share the recording with the new Government Ministers and I will complain to the BPA for you.
