Pip/tribunal

I want to put in a appeal to the tribunal for my pip and understand that I need to do this within 1 Month of the date of MR. There are a few other things which I am not sure about and would like advice.

How long does it take to get tribunal hearing?

Do I provide the same evidence I provided with my original pip claim form and evidence I provided with my MR?

How long time do I have to send the evidence by?

I will be contesting the descriptors that I feel I have not been given the scores. Will the tribunal only look at this or the whole award we're I have been awarded points?

    You have 13 months in total to request it. If outside of the 1 month you must give a reason why you didn’t request it within that time.

    It could take as long as 10 months for a hearing date. 
    You don’t need to send any evidence you’ve already sent because DWP will send everything to them and you will receive a copy of everything in the bundle. 

    They will look at the whole award. If there’s any risk to a current award they usually warn you before removing points. 
  • You definitely need support for CAB, they can support you every step of the way and advise on all the above queries

    On top of advice already given, I would advise you put in your argument regarding what descriptors you think you should be awarded and why, as early as possible  - with or shortly after filing the appeal.

    The reason for this is that many decisions are changed prior to Tribunal by the DWP looking at the decision again properly (which I don't believe they do at MR, whatever they say). Making a good submission when putting in the appeal can often get the appeal changed in your favour, if the other evidence is also supportive.

    So I filled in my personal details and have got to the your reasons for appeal section. It says to refer to your MR decision letter what DWP have put. DWP have put a lot of rubbish in the MR decision so a little confused. Do I write exactly what writed for the descriptors for the MR? And do I send everything as evidence?

         In your previous thread (Pip/MR) I gave you a couple of useful links on appealing a PIP decision, Advicenow and Cit A's adviceguide.

        I would strongly suggest you read those guides if you are uncertain about completing the SSCS1 form.
    (Basically you need to clearly detail how and why the additional points to get you a (higher) PIP award are appropriate).

    As I advised in my previous comment, you do not need to send anything that you've already sent.

    What you should do is go though the bundle the DWP  send you (after submitting appeal) and make sure everything you have sent is in there.

       I think you would be best advised to get help with your appeal from your local advice charity (if they have capacity).

      The Advicenow guide has a useful section on writing a statement / submission for the tribunal panel - I guess from your comment that you haven't read it?

    I have read it but just don't understand the submission bit. We're I live there is no welfare support and local CAB is not much help as they don't answer the door and don't answer the phone.
