Thing here is this was a gift, why was it not marked as such? Instead of being marked as receiver to pay tax/duty.

Op said it came from Poland,

No, the OP was unclear about the source until saying this ...

"So the parcel came from outside the EU from an export service, into the EU which then got passed to an extra company, they're the ones who chose Fedex and we have no contact with them. It's a small forwarding company in Poland"

It passed through Poland. I guess this is one of these aggregation/re-shipping things like e.g. eBay's Global Shipping system, or these irritating addresses that come up as the delivery address for the "genuine UK buyer" that turns out to be a store-and-forward company sending it onwards to another country that loses/damages/delays the item leading to the "genuine UK buyer" having a meltdown ... :/

It was marked gift, however it was valued above the threshold for exemption so VAT did apply.

I forgot to mention the origin in the op which was my bad but did in a later comment. The reason it came through Poland was because it's originally from Ukraine, who's international postal service, under the current circumstances, can't really facilitate air export without parcels going through the EU first, hence the reliance on forwarding freight through Poland.

Anyway, a good update. Fedex, after some back and forth escalated my issue and finally resolved it. ControlAccount on the other hand weren't so cooperative at first, they weren't willing to accept proof from me but set an impossible deadline for me to convince fedex to talk to them or else I'd get fined, which is pretty insane but after some convincing they have since claimed the issue is now resolved.. My account still shows as active so time will tell but I'm in a better position now. Thank you to everyone who comment for your advice, it helped a lot and I really appreciate it :)
