So the company response has been change my 3 day pattern to 4 day breach of contract. HR phoned my store and said 30 days written notice I’m ready to go down route of employment lawyers as I was asked to tackle a shop lifter and also I had my contract breached so this issue may go beyond the phone now. Advice much appreciated

No it wasn’t a business phone but we do have an app to check prices and stock for customers but they usually let staff check to offer good service

    Advice on what?

Your post is very subjective - you don't give actual facts so no body can possibly comment without seeing your contract and T&Cs.

I have moved stores around 5 times due to various issues (non phone related) other reasons.

Then picking a fight over something that is reasonable and within the employers rights would probably not be somenting to pick a fight over as they may be running out of stores to move you to. Or the will to move you?
So we had a fire at one (a staff member had health issues due to it) so I moved at the time that’s one example. Another example was closer to home less travel when we opened a store near here.

I had a ban on phones for staff on shift however we didn't have lockers. We could keep them if off or I just left mine at home - but I'm not fixated by them. Yoof today would be aghast to be separated for any period of time.

Seems @gadget88 has other issues to resolve with the co - good luck with that. HR are looking out for your firm not the employees, try ACCAS https://www.acas.org.uk/advice or a union though they seem thin on the ground these days.

Thanks I guess that’s all I can do. I think you have to pay to be part of union with my company not sure

Yes, of course you do. A union is something you can choose to belong to (or not) and in exchange you get various support, legal representation and other benefits for matters relating to you employment. In many ways it is a form or insurance.

Any yes, it is perfectly reasonable for your employer to ban employees from having their personal phones during working hours or even refuse to allow them on the premises. A locker to keep them in is a benefit but if you don't consider it sufficiently secure then leave your phone at home.

we're not allowed phones whilst on duty either. I don't see the problem especially if they are seen as a distraction

Are you suggesting that the company has breached the contract by changing your work pattern?

Who asked you to tackle a shoplifter and in what way? Did you?

Things that are differerent: draw & drawer, brought & bought, loose & lose, dose & does, payed & paid
