How long to wait before instigating CC chargeback

I ordered some chocolates for my sister's 60th birthday, they were a specific design (but off the shelf) which has great significance to my sister. I verified that the supplier had the items in stock before ordering. When they were delivered (directly to my sister) they were a completely different design of no significance at all to my sister with a hand written note indicating the ordered chocolates were out of stock and so they'd made a substitution. No attempt was made to contact me about the substitution, in fact in the email saying my order had been dispatched they listed the items I had ordered.
I've written to the supplier expressing my dissatisfaction and asking for a refund, but as of yet I've had no reply other than an automated "we've received your message".
How long should I wait before simply instigating a CC chargeback ?

    You would need proof of what was ordered & photo's of what was received for goods not as described.
    What has happened to the chocolates?
    You need to wait & see what company say.
    You have 120 days from when received. BUT do not wait to long, as you will have to provide your evidence by whatever means card co use.

    She ate them. She didn't realise that they were supposed to be special. She was very disappointed though as she  thought I'd tried to pass off her special birthday with some standard chocolates. It was only when she happened to show me a photo of all her presents that I realised what had happened and I then sent her a photo of what she should have received. By then it was too late. 
    To be honest I was also looking forward to the sheer delight she would experience on opening the package and seeing the significant chocolates rather than being disappointed with my gift as it looked as if I hadn't bothered to make the effort for her special birthday.

    I understand that stock issues can occur, but the lack of communication has been extremely disappointing.  If I had been informed that the goods ordered were not in stock, I would have immediately cancelled the order and found an alternative gift.

    You can't eat them and then ask for a refund.

    Exactly which card did you use please - credit. debit, amex, mastercard, visa?

    Given they have been eaten no chargeback right.

    All Op can rely on here is good will from retailer over this.

    No, but the recipient did!


    If the OP was charged for the ordered chocolates and they were more expensive than the despatched chocolates then the OP would have a claim for the difference.
