Furious! Eternity Fire & Security at Oxwich bay but I bought a ticket!

Hi there,

I've had a couple tickets cancelled thanks to the help of people on this forum. Thanks for that, really appreciate the help. I thought I was finally rid of these but then received this yesterday...

I was parked at Oxwich bay near Swansea to go to the beach. The man who sits on the chair at the entrance collected our parking fee of £5 so I was surprised to get this through the post... It seems that the car park closes at 10pm and I left after that. Thing is, there was only 1 sign I could see (afterwards on street view) that shows this and it doesn't mention a fine! There was also no barrier, you could just drive out?!




I'm furious as I paid for the ticket in good faith. To receive this 'fine' is unethical.



I will go through the usual appeals step in the Newbie thread but just wanted to ask if this sign follows regulations?

    Sign doesn't appear to mention any terms & conditions or penalty charges. So should be an easy win a Popla. Were there any other signs in the car park with full T&C ?

    Good Idea - Make sure to take plenty of photos whilst you are there showing all signs or lack of signs ( any which are too high up or obstructed will help you case, also wide angle shots showing most of the car park and placement of signs). Most of these companies are notorious for sending stock photo images of non-existent signs or signs which are no longer there as part of their evidence pack. 

    Case is still ongoing, but read my thread ( quarterly gift from my partner)

    Currently there are no regulations regarding private car parks, the BPA CoP version 9 should be what you are studying, plus POFA 2012 too

    Its not a fine either, its an invoice for the alleged breach of the parking contract there 

    Always question landowner authority and Signage

    Thanks for the NTK images. That is a PoFA worded NTK so 'keeper liability' is invoked.

    Can you get pics of the t&cs inside the car park, if you go in on foot? Is there a sign stating that you agree to £100 charge if your car remains after 10pm? Show us please.

    slow day at the office today, so was doing some snooping around. Appears there might be a couple of shoddy signs dotted around.  Found the below FB page (Appears you are not the only person caught by this trap). There are a couple of photos of the signs in there showing the T&C. Heads up, the signs are rubbish.  Link below

    Also, large conspicuous Font at the top, especially about where to pay for parking, compared to the tiny font in an unremarkable setting near the bottom that warns people about the restrictions, such as the 10pm curfew and any £100 charge for breaching the terms and conditions
