Amazon Marketplace refund

Apologies if I haven't put this in the correct category - I'm not sure where to put it!

I've had a terrible experience buying a refurbished phone on Amazon Marketplace and wondered whether anyone on here could advise what I should do to get my money back!

- On 2nd June I ordered a refurbished Apple iPhone 13 Mini for £329 from a third-party seller on Amazon.

- The phone arrived and for a few days seemed in good working order, but inside a week there was an error with the temperature gauge overheating despite the phone being normal temperature.

- I messaged the seller and requested a return and refund, which was accepted and details provided.

- I returned the phone to the seller on 12th June via recorded delivery (£9 on my part) - details kept.

- On 14th June the seller messaged me to state they had received my package but that I had returned a completely different phone! I immediately told them I had sent the exact same phone back to them and they attempted to disprove me by sending photos of two different IMEI numbers in an attempt to back-up their point - these were two random photos that could have been recreated by anyone.

- I checked the seller's reviews (why didn't I do that first...) and found their recent reviews are awful, with lots of people going through the same kind of thing.

- It then dawned on me that I was being scammed and contacted Amazon's A-Z refund guarantee to claim back my money.

- On three occasions Amazon messaged me to ask for more detail, citing the need for me to attach a return receipt, which I presumed was a photo of the Post Office receipt I kept after returning the phone. I attached this photo each time and asked whether this was what I needed to do.

- I was then refused a refund, which I'm amazed at! I've sent an appeal through with the above details but it seems to be through the same process so I'm not holding out much hope.

My girlfriend paid for the phone on her credit card and we're wondering whether she'll be entitled to get a refund from her credit card company.

Please - does anyone have any other ideas!?

You could try and initiate a chargeback on either debit or credit card but it's complicated with it being paid to Amazon, due to the market place / third party rules you almost certainly wouldn't be able to do an S75 claim

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.
