Minster Baywatch Parking Charge Notice (Swinsty Reservoir)


I recently received a Parking Charge Notice (PCN) from Minster Baywatch (MB) as the ‘Parking fee covering visit duration was not paid in full’. The PCN related to a visit to Stack Point, Harrogate (Swinsty reservoir) which is land owned by Yorkshire Water.
Fortunately, (or so I thought) I had retained the parking ticket I paid for on the day. This demonstrated I had paid the appropriate charge for the duration of my visit.
A copy of the ticket was sent to MB so I was expecting that to be the end of the matter.
MB treated this communication as an appeal, after which they will enter into no further correspondence once the appeal has been decided.
They rejected my appeal on the basis that the ticket submitted did not match the full registration number of my vehicle (shows only TV which is part of the number) which is in ‘in contravention of the agreed terms and conditions for all users of this site’. The company failed to provide any details of the terms and conditions applicable on the site. However, as a ‘gesture of goodwill’ (!) they will accept a discounted amount due to ‘your keying error’.
Whilst I didn’t consider submitting the evidence at the time, my credit card transaction clearly shows payment of the appropriate charge to the correct business on the right date. MB failed to consider the keying error could relate to a system rather than human error.
As an aside, I have found correspondence from MB to be intimidatory and threatening. Details of the Supreme Court ruling referred to in the appeal rejection letter bear no relation to the circumstances of my ‘transgression’.
As MB are clearly a bully boy company, I plan to take the following action hoping to avoid the company instigating court action:
- · Send a letter to the company enclosing a cheque for the discounted PCN advising them this amount is paid under protest but if the cheque is cashed, I intend to make an application to the small claims court seeking to recover this amount plus the cost of instigating court action.
- · Write to the Yorkshire Water CEO advising her of my experience and the behaviour of MB.
Does that sound a sensible approach? Would appreciate any advice on different tactics please.

Have a good read of the NEWBIES thread Announcement. It outlines this forum's approach to dealing with PCNs. You'll find your planned second action point there (Plan A) but I don't think you'll find your first point advised in the NEWBIES thread.3

Thanks for taking the trouble to post Nellymoser & Coupon-mad.Will do as you suggest.Site is about 10 miles from home but I did have it in mind to make a visit to take photos of the signage. Will not be parking on site to do this!3

I'm pleased to report the landowner (Yorkshire Water) have agreed to request cancellation of the PCN and associated financial penalty.As a matter of courtesy I've sent a message to Minster Baywatch informing them but their earlier correspondence indicates they won't action anything outside the appeals process.Hopefully, the end of the matter. Thanks to those who offered advice.4

Please could you add a reply to SUCCESSFUL COMPLAINTS ABOUT PPCs to tell others who to contact at Yorkshire Water to cancel unfair PCNs at Stack Point, Harrogate (Swinsty reservoir)?

I'm in a similar situation at the moment, and I've tried the usual Yorkshire Water customer services route and complaints team but they're either confused about process or just saying "speak to Minster Baywatch" which I'm not going to do.
How did you get your PCN nullified by Yorkshire Water?0 -
