Hi. Many thanks for explaining this rule. I can withdraw the reconsideration then. I knew the benefit was introduced to save the public purse, it seems most unfair to have to repay money you didn't actually receive but if that's the rules. Thanks again

The wording in the regulations limiting the exception I mentioned to a new type of unearned income is as follows:
"Where the period in respect of which unearned income is paid begins or ends during an assessment period the amount of unearned income for that assessment period is to be calculated as follows..."
I suppose you could try to argue that the support component is a discrete element which began during the AP, and this rule can apply to that too. Its a difficult one, but maybe a small chance of success...

Thanks once again. I may let it go to the tribunal in that case...0

Hello. Just so there is a start, a middle and an ending to this, I thought I would post update and pass on my thanks to @xxxxxxxx and @Yamor for helping me with this.
I applied to the Tribunal Service, DWP didn't respond and a reminder sent. They didn't respond and a final reminder sent and just today an appeal writer called me and agreed the overpayment was incorrect and changed the amount, over £200 in my favour.
I felt like I had won the lottery as money is tight. So many thanks once again. Such a helpful community here.4
