    Did they breach their deadline?

    Sent that to your old address?!
    They had a deadline of 4pm on 4 March. From what I can see they sent me a letter dated 25 February 2025 but I never received their letter as they sent it to my old address where they had previously sent all their other correspondence. They have been told numerous times that I moved out of this property at the end of November 2023.  I received an email today and they attached the letter they sent to old address.

    I think forward that email to the court and say this is further proof that the C has continued to act wholly unreasonably. Here is evidence that - despite knowing that the whole point of the CCJ hearing was due to them using the old address for the claim form, they then negligently breached the Judge's Order dated xx/xx/25 by (astonishingly) repeating the known improper service to the same old address!  No wonder the further POC were not served. The Order is breached.

    @Coupon-mad & @Johnersh They cc'd the County Court on the email that they sent me yesterday and again from just what I can see in the email a copy of the letter dated 25 February 2025 was also sent to Salisbury County Court.

    Does this matter? If not do I reply to the County Court with the following and cc PE in:

    Dear Sir/Madam 

    I never received the letter dated 25 February 2025 as I have mentioned on multiple occasions to the Claimant, I have not lived at that address since the end of November 2023. This is further proof that the Claimant has continued to act wholly unreasonably.

    Well, I wouldn't finish a business style letter with "kind regards", it should be "yours faithfully".

  • I sent the following email on 19/03/25 to the County Court & cc'd PE Ltd in

    "Dear Sir/Madam

    As expected. Claimants get away with murder. The court has merely given you both more time to comply.

    So, study the February POC and draft a defence responding to it.

    What is your defence? That somehow the paystation gave you a ticket back and preauthorized exit but oddly the card wasn't charged?

    Because if so your defence doesn't say that. The court doesn't really care what you did on other occasions (and at best that is for witness evidence) you need to respond to the allegations of breach of contract. 

    By all means reference the service failures, but that has now been dealt with. It's not the lead issue. There's an awful lot of complaining in the defence that is masking what may be your best arguments inho...
