Is it legal to charge for repairs but not do them when returning a vehicle ?

hi all i am excersing my VT right on returning a van, i am the 5th user of a van bought at 90k now going back at 120k, i have taken good care in my time, however when returned the finance company are treating me like the second user, as saying it has not been serviced since 45k miles, i bought from small back street garage, when i questioned it they even said it is company policy and as van is now sold at auction the money they seek will not be forwarded on to the user, this is not right in my eyes, no one available to help !! ??

Why would they give the money to the new buyer? The new buyer will have paid what they deem the van worth with no service history which will be less than if it had a full service history.1

Do you have paperwork for it having been serviced? Did they have any evidence it was serviced before you bought it?
Since it's a van, was it a business or consumer transaction?

exactly, everyone buys the vehicle as they see it, at the end of time they sell it as is, in my situation i am using my rights which is Voluntary Termination it says as long as i have paid half of the amount and taken reasonable care of the goods you will not pay any more. however they want to charge me £ 3k for scratches and dents that was on the van when i bought it, probably the 3rd or 4th user. they also say it has not been serviced since 45k miles, this is what happens when it enters used market not many people still go to main delears for repairs due to their high costs that what keeps little garages in business. Vauxhall want to charge me £ 3k but the van has sold at auction and will never get repaired so why charge for it ( illegal i would of thought ) vauxhall say it is their company policy to do so, they were only used for finance ie bank loan.i buy the van from garage i set up the finance deal with car money they approach vauxhall to finance it, then here i am paying for someone else marks not right in my view. yours?0

Some time line of how old the van is, when you bought it etc. Did you take out the finance?
As why do the finance co think you are the 2nd owner, yet you say you are the 5th? Makes no sense, other than people have been selling van on, but the finance co have not been made aware of 3 changes of ownership.Life in the slow lane1 -

Was this a personal van because you do motocross as a hobby or was this a business van for your work?
VT stems from the CCA which only applies to personal finance, if it was a used for work the CCA and its rules on VT won't apply.
Yes, it is legal to charge for works and live with the damage instead. You are paying for depreciating the asset, repair costs are just a simplified mechanism to proxy the devaluation. Was an interesting court case on the matter a few years ago.0 -

So you voluntarily bought a 90k van that hadn't been serviced for 45k, then you didn't service it in the 30k you had it?2
