Virgin connecting US flight cancelled

Hi 

We booked flight from Manchester to Raleigh, Durham (USA) with connecting flight from JFK New York with Virgin Atlantic.

On arrival to JFK, advised that connecting flight had been cancelled (with delta airlines).

Next available flight 24 hours later with different airline:

No offer of accommodation, meals etc. we booked and paid for hotel ourselves. 

I have put a claim in to Virgin for cancelled flight, accommodation and compensation.

they have come back saying basically it’s not their fault. They are only the “marketers” of the connecting flight albeit we bought it from them and told us to contact Delta (who are saying contact virgin)

what Are our rights please? Surely our “contract” was with virgin as that’s who we bought the flights from. Who should I be pursuing?

    Your outcome is down to whether you booked your flight in a single booking from virgin (eg Manchester to Raleigh) or whether you were unfortunate enough to use an aggregator who made it look like a single booking.  
    If it was a single booking then virgin should be talking to you. 
    There’s not much protection in the US for internal flights.

    I booked it on virgin website and searched Manchester to Raleigh. Do I argue with virgin then that it is their responsibility? Thanks so much

    Both airlines are responsible for sorting this out between them, and if Delta fail it's on Virgin. The case law here is "CS And Others -v-Ceske aerolinie"

    Push back on Virgin, quote the above judgement, and take them to ADR if needed. They are chancing their arm here.
