Section 75 protection

Hi,

I’m having some works done for £30K.

In order to get protection, I’m paying a £1K deposit by credit card. The rest of the payments will be staged and made by BACS.

My parents have offered to pay for the work.

Does this present any problems in the unlikely event I needed to make a section 75 claim? All quotes and invoices in my name, but my parents paying £29K by bank transfer with me having paid the £1K deposit by card.

I presume the credit card company will want proof of payment etc  if I needed to claim. Would it matter that the bank transfers were not made by me?

    Just get your parents to give you the £29k and then you make the payments.

    MSE doesn't always get it exactly right, but in your shoes I'd be double checking whether the upper limit for S75 protection is for purchases of £30k or, as MSE implies, £29,999.99

    When you say £30K what exactly is the price? Just so you will get a clear answer. I would also get parents to pay you & then you pay builder. Takes any ambiguity out of the process. make sure you get full T/C etc from them.

    Although S75 is not a get out a jail free card insurance. It only covers breach of contract or misrepresentation.

    Ring card provider to confirm.

    The actual wording of the legislation is:

    (b) so far as the claim relates to any single item to which the supplier has attached a cash price not exceeding £100 or more than £30,000 

    So it's up to and including £30k, so no need to negotiate a 1p discount.

    The legislation doesn't mention how much is paid by regulated credit (eg a credit card) just that the price of the item must be at least £100 and not more than £30,000

    Wrong, even 1p on your credit card means you are covered for the value of the order, provided it meets all other criteria

    No, if you make any partial payment by credit card then S75 covers you for the whole amount, not just the amount paid by card (subject to the qualifying limits).
    Are you perhaps getting confused with chargeback?  For chargeback, it is only the amount spent on the card that can potentially be refunded.

    Until OP confirms exactly what the amount is it's a bit pointless.

    All I can say is (b) makes no sense...
    Cash price "NOT EXCEEDING" £100???

    As anything under £100 is not covered. So a item has to exceed £100

    No, the legislation is defined in negatives, ie all transactions are covered unless the below apply... (a) is that its not a commercial sale
