Civil Enforcement Limited

1 We tried to make an appeal on the wen site but the thing did not work and there are no other e mail addresses.
2 So we have written in defiance of the rules on the web site. We have posted more than one copy so that the " it was lost in the post " excuse will not fly 
3 The other trick is the posted PCN was posted so that the 14 day discount period had expired !  they used the wrong PCN and failed to correct the dates.

Our fear is that the 28 days falls due soon and we have no reply. has anyone had similar issues with them? 
Have they merely sent additional final demands ?
Have they moved to County Court and if so how long after a final demand letter ?
Have CEL torpedoed their position already ?

    Have you read the Newbies/FAQ thread yet? That is your bible and should be referred to before you post questions here.
  • I did have a read through but the comment above is less than helpful . If I have done something wrong ..sorry . I went to find the bible and did not find it !

    Are you saying that you cannot find the Newbies/FAQ thread which is stickied on the very first page of this forum?

    At the very top and bottom of every page is a "breadcrumb" that says "Home > Motoring > Parking tickets, fines & parking". Just click on the highlighted bit of that "breadcrumb" and it takes you to the very first page of the forum. At the top of the list there are number of "sticky" threads with an "Announcement" tag. There you will see one titled "**NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou!"

    There you go.

    CEL are a bunch of intellectually malnourished ex-clamper thugs whose sole aim is to extort and scam money from unsuspecting, low-hanging fruit on the gullible tree. Anyone discovering this forum and reading the Newbies/FAQ thread and following the advice should not be considered either unsuspecting nor gullible anymore.
  • LDast thanks for that . I did get an idea of essence of the company from a few sources. I looked them up on Linkedin and Company Info. That gave me an idea of the structure of the company. and so what to expect. We sent via the complaints e mail to get a reply saying that they would not deal with it. A great way to admit service and obstruct at the same time. The leadership of this company appear to be South Africans! 
    1 I was just hoping that others had this swapping the PCN and playing with dates experience and to share that specific tactic which I did not see in that list.
    2 I am trying to guess what they will do next and when. 
    3 I suspect they will go full final demand and then things get funny ! 
    If they go to debt collecting then it can be taken that they have rejected the appeal and so POPLA would be open but I suspect that they will go straight to debt collecting style letters. In my experience timing of communications is key and thinking how much time I have before these steps was what I was hoping to  get a feel for.

    You have confirmed the general view that so many have suggested with less than subtle descriptions but you can see that my thoughts were not well covered in the threads. Thanks for the input 

    There have been moves to sort this out in Parliament and I suspect a real campaign against these kind of tactics need to be pushed. If they cannot get DVLA or have the charges reduced they will fade away. That was the plan but the code is just a code at the moment from what I read.

    Yep.  I'm on the Government Steering Group which created that statutory Code of Practice and things were about to be finalised when suddenly the General Election was called earlier than many people expected.

    So it has to be 'on hold' for a couple of months, but believe me, AIUI everything is pretty much in place for a final consultation and Impact Assessment, regardless of which party and which Secretary of State launches it.

    The Consumer representatives won't let it go. We are all over it like a rash.

    I hope your appeal didn't say/imply who was driving? No phrases like "I parked / I did this".

     Thanks for the advice. I will look to edit the appeal. So far we have just said that low paid worker giving care to the clients so cannot afford .plus signs are not clear.
    I have not used such a phrase but always good to check .
    In this particular case there is no indication of private car park at all except a sign that does not have the charges on it that is partly obscured by a tree ...there is more to it but the signs are typical from what  have seen by CEL. They are not correct but could claim to be so. . However if they keep reducing the font size then it is against the code that BPA publishes. The time limits are also set out in that document and CEL are playing nasty ! 
  • CEL used ANPR and back dated the PCN . So dates and times was one issue but there no sign for CCTV. So I have demanded the full coverage record plus the posting dates ! ...I am being a pain on purpose ..Challenging the evidence basis ! They have to have proper signs through out the site ( ?)  I have also challenged because the car is moving in the one image and so have asked to prove that they have 2 correct pictures with the car at rest !

    POFA or non-POFA NTK (don't show us). Just compare it to the pics in my thread of NTK pictures which shows both types.
