Third party claim on guilty party's insurance

    The guilty party was in the left lane, marked to go straight ahead ONLY to join the M25.

    I was in the right lane, marked to go ahead to join the M25 or to turn right to go to the next exit. If you want to turn right, that's where you should be even if you have to wait a little longer.

    The guilty party turned right, to go to what he said was his usual exit.

    So, both lanes were designated for cars taking the M25 slip-road exit and thus the car in the left lane would've had to turn right across cars potentially taking that exit.
    Of course, people do make mistakes, but the car in the left would have to ask nicely to go right and make sure they'd been let in.

    Op. What is your desired outcome?

    If the other driver is denying liability - it’s unlikely one day he’s going to just admit it was his fault 

    to take things further ie court your going to have to get the repairs completed then sue for the repair cost

    At the moment is there any evidence to support either driver

    Yes, that is the case. Unfortunately, he did not do that (he drives a 3 litre BMW, he may have thought he was quick) and he certainly did not pretend that I had given way. He just wanted to know whose fault I thought it was. He did not deny he drove into me, at the scene or in written communication.

    AND three months ago, the evening rush hour took place in the dark. It was also wet. He indicated he was familiar with the roads. It was a very irresponsible way to drive in the circumstances.

    My opinion is the fault was the other driver's.
    My other opinion is that it should have been passed straight to the insurance company to deal with.
