N180 new compulsory mediation
or
N180 mandatory mediation
...very new changes not yet reflected in the advice.
There is 1 question there I would need an advice on:
D1 Do you consider that this claim is suitable for determination without hearing, such as by jusge reading and considering the case papers, witnesess statements and other documants filed by the parties, making a decision, and giving a note of reasons for that decision?0 -
You should be waiting for the N180 to arrive in the post, then look at it to see if its the new version or the old version, because the answer to that conundrum will determine which version you should be using, especially if its the new version in the post
If its the old version, offering mediation or not, choose not
If its the new version, you dont get a choice , you get a free mediation interview
Look for the recent posts about it, like the one below

NB, the pilot scheme was running for a few years, but is supposedly mandatory from may 2024
The old version of the N180 was provided in a download link. (. Dropbox ? )
If you need further advice, please use your own existing thread0 -

No extra advice needed on that last question because the NEWBIES thread covers it. Have another look.

Update Time
I submitted my defence last month and was awaiting a court date.
Instead, I received a letter titled 'General Form of Judgement or Order'.
Within it, the Judge (Preston County Court) has struck out the particulars of the claim as they do not disclose any reasonable grounds for bringing the claim and they do not sufficiently particularise the agreement upon which the claim is based.
The Judge has then provided VCS Ltd a further two weeks to provide a copy of the contract or documents constituting or evidencing any agreement on which the claim is based.
This was a stage I wasn't expecting - I was expecting either a court date or awaiting VCS/DBL to call it quits.
I'll let you know what happens next.3 -
That is a good thing. The court can smell a rat when dealing with VCS and is putting them under pressure to abide by the rules and pay fair, which they don't usually do.
Please show us the amended PoC and the copies of the documents they have been ordered to provide (they must copy you, the defendant, in on anything they send to the court, just as you have been copied in with the court order given to VCS. Of course, they may just throw in the towel and discontinue.2 -
