I assume nobody has ever been picked up on this, but wonder if it is worth adding to the guidance just in case?

To my mind it is too late to ask for a telephone number AFTER something has been submitted, if it was a genuine requirement, this should be prominent somewhere, maybe on the claim form.3

Hi everyone, update time.
I submitted my defence, adding to the template, hoping I'd shock DCB Legal into submission with my extensively researched knowledge.
No such joy though and they have informed me they wish to proceed to court, but I can avoid this by giving them a ring and sorting it out.
Of course, I have no intention of ringing them.
I believe this now puts me onto Step 7 out of 12 - which is at least another step closer to end game.
I noted that the HMCTS letter does state the claimant has 28 days to respond after receiving my defence or the case will be 'stayed'. Has anybody known a claimant fail to respond and just let it die off that way?

Do not phone anyone, the newbies sticky thread and the defence template thread warned you about this and you should stick to following the 12 steps, this interim stage is just part of the process and was inevitable. The lawyers were doing what their client told them to do , which they do dozens of times daily, they certainly weren't going to be shocked into submission, it's all standard stuff to them, its just a part of the job
There are plenty of examples of claimant's failing deadlines but you should stop speculating and just deal with the process as it unravels. It may be your first rodeo but its all predictable old hat to the Claimant and to the lawyers
There is nothing to see here, please move along , keeping your eyes on the MCOL claim history twice a week2 -
Hi @Gr1pr - thanks for the tip about checking the MCOL claim history twice a week.
Why would I do that though? I haven't read that advice on the Newbie thread anywhere. Nor is it mentioned on the 12-step process.
It was my intention is just to wait for the DQ which I believe comes through letter/e-mail.
Cheers.0 -
Correct, by post. ( Not by email at all. ). , but then you will know that its been posted and when, because it's a short deadline to email the completed form back and there are other threads here that you are not reading where its not arrived and therefore not submitted, meaning that the defendant ends up with a general sanctions order against them, or worse , due to not checking so not expecting it
Your MCOL claim history is your best source of information, so why wouldn't you keep checking it ? Safety first , just like your bank account, seems obvious to me. ( And I have never been through this. )

I think the reason I haven't been checking it is because of this comment in the guide;
As somebody who is following the guide closely, this information made me neglect MCOL, for quite an obvious reason I think. To continue your banking analogy, it would be similar to saying you pay in a cheque on the app - the only thing you must do on a banking app. When in fact you should continue checking it for updates etc.
So thanks for providing alternative information that MCOL is still relevant and does provide more purpose than merely submitting the AOS - it provides relevant and important updates. I've now bookmarked the page for the regular checks.

Acknowledgment of service was received on 20/05/2024 at 01:05:58With a Claim Issue Date of 13th May, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 17th June 2024 to file your Defence.
That's three weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website.
Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.Keithp alludes to it in his reply to you back on page 1, not much help if you dont read it periodicallyYour cheque analogy is correct, as is checking bank accounts and credit cards online regularly for any irregularities, rather than only finding them or scammers after your monthly statement arrives
You shouldn't be relying on royal mail post pandemic, their delivery record these days is woeful compared to previous years, well publicised recently2 -
