    I think I would take the 5K , it could be a long fight to get anything more ,you have done 4000 miles so there would be a reduction, although I do agree that 50p per mile is to much

    If you're going to reject it you should stop using it. If you keep putting miles on it after the first indication there is a problem then its pretty easy to prove the reason you've rejecting isn't valid - as you can still drive it (and saying you needed a car isn't a defense).

    Given your current situ - I would try negotiating the 0.45 to something like 0.40 and accept it.
