  • I've had a response back from the solicitors, they're not willing to confirm who's the land owner or disclose any further information :/

    Dear xxx

    Secure Parking are the Claimant in this litigation (or threatened litigation).

     Therefore you must deal with them.

    Any enquiries for disclosure must be directed to Secure Parking.

    Baches Solicitors LLP, will not be providing any disclosure unless we are properly served with a sealed Third Party Disclosure Order made by the Court which compels us to release such documents.

  • I sent off my defence today, didn't want to miss the deadline. I went with this in the end:

    The Defendant denies liability for the alleged parking charge and contends that no breach of contract has occurred.  The Defendant briefly stopped near the entrance of the car park to take pain medication due to a flare-up of a pre-existing shoulder condition.  The Defendant did not exit the vehicle or park in a designated bay. The stop was brief, necessary and made solely for medical reasons, without blocking access or causing obstruction, before continuing the journey. The Defendant argues that this action does not constitute parking and does not breach the contract terms.  The Defendant therefore asks the Court to dismiss the claim, either due to the poorly pleaded POC ('Unauthorised Vehicle' is neither true nor clear) or due to no signage at the car park entrance and the lack of prominent signs.

    Sorry to jump on to your post.

    I have nearly exact situation, with secure parking and outside the same car park on cov road. This was on the forecourt/extended pavement with no parking bays and the driver didn’t go inside the carpark which the sign had a big arrow indicating the car park entrance. (Not even directly outside of jt as the image shows a car was blocking entrance) it was infront of the shop/solicitors firm.

    it’s currently at the final notice in DCB. The driver is going to be travelling abroad at the end of the year and doesn’t want to miss any potential letters of claim. He wants to know an idea of timeline from the deadline letter to the letter of claim and the others following.

    Just wondering what happened in this case?

    It isn't safe to go travelling abroad when a court claim form will arrive (because it will) UNLESS you put a trusted relative or housemate in charge of your post.  You cannot risk missing a court claim as that gets you a CCJ if undefended.

    Hi guys sorry, I needed some more advice. I've now received my hearing date, unfortunately, it's during the kid's half term and we've already booked a holiday to go away.   I will file my evidence and witness statement before the hearing date but won't be able to attend the hearing as I'm abroad.  Is there any option for me to rearrange the hearing?
    Alternatively, do I gamble that DCB Legal will discontinue before the hearing?   I'd be grateful for your advice.

    When you submitted you N180, what dates did you input as unavailable?  Did they cover the half term in question now?  You can try to rearrange but it has to be with the agreement of the claimant and will cost you a fee. You could also gamble on a discontinuance but will have to submit your Witness Statement on time.

    Further to this message, I just got an email from DCB Legal with Notice of Discontinuance, result!! Thank you so much for all your help guys, you've been amazing!  Is there another forum where I can let people know I've also been successful following this guide?
