  • I have received the same email twice now from close brothers - saying they can't find my details and to fill out a form on their website. Underneath it states that if I fill the form out and they still can't find my details there is nothing they can do.

Thing is they are asking for more details but the extra details they are asking for I have already given them.

They have my name, D.O.B, address, vehicle reg, make, model, the year I purchased the vehicle - there is really nothing more I can give them.

What is the next best thing to do?

*I also provided them my policy number

If they have deleted your data or archived it in such a way as to only be able to use your agreement number to find it, there isn't much else you can do. From what dunstonh has said, part of the delay in this is dealing with cases like yours where firms no longer have data and thus knowing if you were affected at all. All I could suggest is old emails, old paperwork/archives which you have probably already looked through. End of the day if they and you have no record you had finance then no way to know if you were affected and thus if you were due anything back. Then again, FCA might say that if say all their deals had DCA and all of them used it to inflate interest rates, maybe they have to give you a compensation amount based around the likely finance value or something. Remember they may still come back and say there was no mis-selling

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

Thanks for your reply. I have an email from close brothers which has my name, vehicle reg and policy number on. It isn't the policy agreement but Isn't that classed as a record? And proof I had finance with them??

If it includes the agreement number, then some firms archive the data before they destroy it.  And the most common archiving reference is the agreement number.

Remember its not that you have proof that you had finance.    It is so they can locate sufficient records to identify whether DCA was used with yours or not.

Towards the end of the PPI issue, the regulator instructed banks to bring archived data back onto systems.  It is a slow process but some people are still being contacted years after the end of the PPI issue to be told they now have the records and are reassessing the file.    THings like this will be addressed in the FCA report.

I have dug through all my paperwork and found my policy agreement so hopefully they can find me now and I haven't been deleted.
It was 2013 I took out my finance so long time ago.

    Thanks for your reply :)
  • Have managed to trace a few PCP's via Martin's template - had 3 with Close and they can only find one - getting the same "can't find" emails on the other 2 though have given the dates, registrations and direct debit amounts from my bank statements - these 2 are from 2014 and 2015.  Is there any benefit in trying to a 3rd party claims co to trace these 2?  Know they'll take a chunk, but is something better than nothing - or will they face the same challenge?

Your finance agreements are not in the public domain.   There is no third party that can trace them.

So we filled in the form and sent it off, close brothers came back saying they can’t find details. We then sent photos of the agreement but they have now said it is with close brothers finance and they are close brothers group. Are they not the same company?
