    Hello all. I am here again. Today is now 14 days to the hearing and I have not received the WS from the claimant as instructed by the court. Also, I have not received any communication from the court that the case has been struck out.

    Is this a good thing or bad thing. What should I do if I do not receive the claimant WS by the end of today?

    Contact the court to see if the court fee has been paid , or discontinued, because that deadline must have already passed, do it today, don't wait

    Yes ring Willesden and ask if they received your bundle and what else is happening?  Ask them: is the hearing proceeding?

    Already called them. I gave up because I was in the 100 position waiting to speak to the court!

    In this age of technological advance, you expect civil matter cases to be computerised and parties can look online to see the status of their case! I am on the call to the court and my waiting position is 64! Unbelievable. Anyway, I will just wait till it is my turn for the next two hours

    We certainly agree, the system is very archaic and needs a major overhaul, bringing in improved IT measures like the CNBC in Northampton, or the DVLA in Swansea 

    Perhaps you should complain about the system as a whole to your local MP and ask them to copy in the Justice minister. ?

    Dear all,
    Finally, spoke to the court after 1hour waiting ordeal. The court officer I spoke to said that the case is discontinued and I asked if I will receive a letter to that effect from the court. He said no.

    Anyway I have already sent my WS to the court and the claimant just to be on the safe side.

    It will be weird If I do not receive letter from both the court and the claimant that the case is discontinued.

    If I do not receive formal letter of discontinuance from the court and the claimant, should I still attend the court date on the 23 August?

    No don't attend because you are safe: a court officer told you it is discontinued. So you won!

    ANOTHER ONE BITES THE DUST!

    Check your junk email.  If not there, email the solicitors - which firm, DCB or BW? - and ask them for a copy of the Notice of Discontinuance because they failed to serve it and you want a copy now.
