So sorry. Being honest with you.

Very, very few cases are worth appealing.

Even if you don't pay court fees, you'll likely be ordered to obtain the hearing transcript before the higher Judge will even consider your application.

And I see no grounds for appeal. Technically that is public highway going by the true definition.  Highway (road) accessible by vehicles.  No driver should ever stop on double reds.

    Dear all.

i am here again the more i want this to settle quickly the longer it takes.

as i lost the case and court order to pay £212 on 14 May - i requested court to make me pay in installments and judge told me to contact claimant and if not work out then i may revert back to court for assistance.

i emailed Gladstone solicitor Joshua who sent me bundle and emails previously requesting to make an arrangement for payment, but i did not receive any response until today i received email from Gemma asking to pay full as CCJ states must be paid by 28th May, i forwarded Gemma email i sent to Joshua on 22 May and explained that i did make a request within time or before but no response has ever received but Gemma insisting that i must pay in full as time has elapsed and they are unable to facilitate with this.

should i contact court or what would be the process as she advised to get a independent legal advise on this process.

Greatly appreciated all the time into reading all this and eveything.

I'm sorry. You must pay in full.  You always had to. You should NEVER have delayed this asking to pay in instalments.

If that's an issue, borrow it from a relative or friend them pay them back. That's what you needed to do, not this.

You had to pay it in May, didn't you? You can't muck around with these things. A CCJ is risked!

Please tell us you are not saying it is now later than the court Order and you've now got a CCJ because you didn't follow our advice to pay it in full immediately?

i was told to contact claimant to arrange installments as i am a carer on UC and court told me to make an arrangement with claimant if claimant dont agree then i can ask court .. which i did by contacting the claimant on 22nd may ..by the way i never received any correspondance from court and did not know the deadline and neither i received any response from claimant on my requesting them to arrange intallments.

yes email received from claimant solictor shows the ccj deadline 28 May but i contacted them on 22 may which they never responded to.

even for hearing and directions from court i never received .. and tried emailing them to update address but seems like court have wrong address and they were notified on multiple occasions to amend this namely from Aug last year.

Yes, that is a County Court Judgment.

I have no idea why the Judge did that to you.  What a terrible Judge, IMHO. The only good thing they did was disallow the fake DRA fee the C tried to add.

The Claimant didn't even turn up and they still won, and the Judge couldn't even be bothered to set out an instalment plan within the Order.

You will have to borrow the money from a relative and pay it in full this week and hope no CCJ appears.

OR see your local Money Advice Service this week - immediately. They probably do a drop-in session. Might be the same building as your local Citizens Advice.
