    Afternoon all,

Just wondering if anyone knows what happens regarding court costs and legal fees if we end up staying in our home despite a valid Section 21? We haven't received one yet but believe it to be imminent as the LL has started throwing the word around in messages. Still not sure why she tried to demand July 1st when, apparently, she's well aware of what she needs to do and legally provide.

We're still waiting to hear back from Nationwide regarding our house purchase. Offer accepted in Feb, DIP agreed same day. All conveyancing done and awaiting final signatures from both parties. Homebuyer's survey complete. Just the valuation seems to be taking weeks and we're expecting it to fail at this hurdle, unfortunately. Our MA says it's all green lit pending valuation and their people just don't seem to be alive and responding.... The tension and stress is unbearable.

So, if we try to push past a valid Section 21, wait out the next two months, and then the LL starts to initiate Court action... Will that be something we'll begin to lose finances on immediately? As an example, if we push beyond 2 months, wait for a hearing date but then leave before it gets that far, will we still be looking at legal costs? Any other costs to consider also?

Sorry for the daft question, I've just never been in this position before.
It’s not a daft question at all, but I answered it further back in this thread- 11 May.

In practice, it costs the landlord far more to get the ball rolling with eviction than she can possibly get back from you. So, I suggest that you keep her informed about how you are proceeding with your house purchase, in which case she may not start the court claim at the earliest moment.
Thank you, you absolutely did! Thank you for the additional clarity though. That's very reassuring!

What she hoped for was that you wouldn't know your rights and just roll over and accept her asking you to leave by July 1st!

That would have cost her sweet FA!!!

You're absolutely right. It was opportunistic of them and ignorant.

Unfortunately, I have now received my official and date correct Section 21. I'm looking into the possibility of staying with family until I either decide to rent again or until a house purchase succeeds. (Current house purchase becoming increasingly complicated.)
I'm aware that I can push past the notice and remain where I am until it goes to court but if staying with family is an option, it's certainly something to think about.

Why don't you ask your LL for £2,500 as a sweetener for you to leave on time?
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

I mentioned that we were looking at a potential shortfall because of the house situation and they suggested we put it on a credit card.

Which, as you know,  will be very expensive because of the interest charges

Exactly and with our current mortgage application possibly breathing it's last breath, I don't fancy risking any debt or interest charges. 🤣

If you can stay with your family until you have a house bought and ready to move into, that would put you in a very good position. As you won't have to fear delays in the buying process. Just keep your family up to date about what is happening.

Note: clearly I don't know your family, so this assumes a good relationship. But, if a good relationship, that would solve many problems.

Thank you for your support and suggestions on both of my threads!

Staying with my mother is very much an option. I've had a good chat with her about it just recently. We have a great relationship and she's insisting she won't accept financial contribution. She has a spare room in the house I grew up in. She has mobility concerns and would possibly enjoy us doting on her for a couple of months. The only concern is that it's over 70 miles from our work commitments. Each way. That's quite a commute.

Not for house-buying reasons, but I spent a few months travelling to London two days a week from Leeds. I used the National Express coach, catching the 5am coach to be ready to work from 9am. Possible :) It would be a stretch to do that for five days a week, however.
