Punitive damages are not "illegal" in England and Wales or Northern Ireland, though they are only awarded in specific and defined circumstances. Punitive damages do not exist as a head of damages in Scotland.DullGreyGuy said:
In the UK punitive damages are illegal, someone cannot be awarded large damages because of the scale of the mistake made by the defendant only the level of damage sustained by the claimant.
