Ok so Met have refused the appeal. time to go to POPLA.

Can anyone point me in the right direction on these. Are there any templates or examples of the points i need to raise ?

    1. NTK is not POFA compliant - Only 1 photo of entry time , no exit photo or what is the maximum duration allowed.
2, When I went to check on the details on their website. There are photos showing entry and exit and vehicle reg. but no photos of the signs they mention or the allowed maximum period.
    3. They did not confirm their grace period agreed with the landowner on this location.

Not sure if there is anything further to add?

Make sure the POPLA assessor understands why their NTK is not POFA compliant and they cannot hold the registered keeper responsible.

The NEWBIES FAQ Announcement, third post, has near ready template appeal points to use.

This is a standard checklist, as often posted by forum stalwart @Fruitcake.  Key points to include in any POPLA appeal:

    1) Non-PoFA compliant NTK/NTH (if appropriate)
    2) Not the driver/not the person who may be liable for the charge (if non-PoFA)
    3) Not the landowner/ No landowner contract
    4) No standing to issue charges in their own name
    5) Inadequate signage
    6) BPA CoP failures (if appropriate)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

so , i am in the inadequate signage part. Problem i see is that this is a small cark park, there is a clear boundary and a big sign advising its a private car park at the entrance. There are also plenty of signs dotted around and visibility would have been good at the time of day.  The only things i can think of are :
    1) The first sign is quite high up and small writing, so difficult to read from a drivers perspective.
    2) All the other signs are on the fence behind the parking bays sometimes obstructed by parked vehicles, making them difficult to access when the parking is busy. You are a disabled person or with young children ( buggies, pushchairs, etc)

Mt GF will be taking some close up shots of the signs this evening to check if they are DPA/GDPR complaint, etc.

Those GSV photos are over 6 years old. You'd need more up to date photos.

@Zbubuman if you have appealed any PCNs in the past and including your experience now with this one:

Please earn yourself £60 and help regulate the parking industry.

This is an official thing and MSE Towers has agreed I can share it...

Short notice but do the survey now (and then a short & friendly video call next week) to tell the Government's consultancy outsourced firm your experience of 'appealing'.

URGENT - help us push the regulation of the parking industry and new appeals service over the line.

There should be appeal (ADR) available at ALL stages to keep cases out of court.  You'd be a good person to get that message across.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

My GF will be taking a photo of one of the signs this evening. If my recollection is correct, I dont believe anything has changed with regards to layout and position of the signs. But will envision to go there myself and take a few more.

I have just Googled and found the Krispy Kreme, New Malden website. On the ‘See outside’ section it provides access to StreetView of their car park. Comparing that with the single photo on the NTK it is clear from the road markings they have taken a photo of the car entering the car park. They have not provided any evidence of a breach

So my GF only had one mission to do. Go and take a photo of one of the signs. She comes back with the lowest quality photo possible, to the point where she will put most parking companies and their attendants to shame  :( . At least that's what she has emailed me, will check her phone later on today.
