Yes.  You should never have posted anything. An emailed acknowledgement would have saved you close to £300 (as long as the Defendant had defended in time as well).  All could have been done by email.

Why did it take you over 14 days from the 08/04/24 to try and access the MCOL portal to the eventual date you decided to send the AoS form by Royal Mail and thus missing the crucial deadline? You could just as easily downloaded the AoS form and emailed that to the CNBC.

If you now pay the CCJ within 30 days of the judgment, there will be no record of the CCJ on your credit file. It will be expunged.

If you still feel badly about having to pay something you would not have had to pay a penny for if you'd only come to this forum first, you can try and get it set aside but it will be an expensive uphill battle with no guarantees.

I cannot see that you have any argument that may help getting that Judgment set aside.

It saddens me to say that I think the most cost effective thing for you to do now is to pay the Claimant £289.52.
Read the How to Pay box on the back of your Claim Form.
This will then wipe the CCJ from the credit file? As it’s within 28 days of 24/04/2024?
    Yes.

Just to add that I see that there are more comprehensive instructions on how to pay on that Default Judgment form.

It will wipe the CCJ from the public register

I believe that the set aside fee has gone up to over £300 , with no guarantee of getting it back and possibly still losing as well

If you can PROVE that the AOS arrived at the CNBC in Northampton before April 22nd then you could email a complaint to the complaints email there, because they are snowed under and have various admin problems

If it arrived AFTER the 22nd then I doubt that the Judgment could be set aside by the CNBC at zero cost to the defendant

So the date of posting and date of arrival at the CNBC is crucial for any complaint

Thank you all for your support/advice - very helpful.

can there be a more payment plan set up and that still removes the CCJ or will the payment have to be made in one go?

Would it be worth still logging a complaint about the issues faced after the CCJ is removed?

The judgment gives time to pay in full, no payment plans, no options, only pay in full within 30 days of the date of the judgment

If not paid in full , its not settled, so cannot be a full settlement, so stays on the register for 6 years

    This has already been mentioned...

    The converse is also true.
I.e. if you don't pay it all off within that timescale, a Judgment will remain on your credit file for the next six years. It will be marked as 'satisfied' once it is fully paid, but will still hinder any attempts to obtain credit - think mortgage, phone contract, etc.

No that cements the CCJ for 6 years.

    DON'T even think about it.

A "satisfied" CCJ on your record is about one degree less painful than a 100 degree burn for an "outstanding" one.

If you need to make payments in order to be able to afford to pay this, then make quick arrangements to do so from a reliable and trustworthy source and pay the CCJ in one go.
