    I refer to your Letter Before Claim.

    I confirm that my address for service for the time being - assuming you don't delay any claim - is as follows, and any older address must be erased from your records:

    The alleged debt is disputed and any court proceedings will be vigorously defended, as I have done successfully in the past.  My vehicle was not parked within Piccadilly Trading Estate as you allege.

    I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').

    I also have a question, and under the PAP I am entitled to a specific answer:

    1. Regarding the £100, please confirm if this is nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    Would that work? It would take me 2 mins to send it and i would rather acknowledge than ignore... Id like to be seen to trying to engage.

    PCNs are exempt from VAT.

    It's only the fake costs add-on that isn't.

    Ok so its:

    I think i will send this on day 28 or so, as I've got to get postal version of the Land Registry documents which may take me longer than i thought (too big to email apparently)  The extra 30 days will allow time for them to process my request.

    @Coupon-mad - why no SAR at all - just for my education? Does that come later? I can't recall the sequence of my previous case...

    If or when you obtain a SAR reply, its to gather everything they have on you as a data subject, your data, Which includes documents and pictures, but nothing that isn't your own data, like contracts, maps, signage etc, so the latter are part of their evidence pack, but are not your data 

    So you get more information, or missing information, but not everything they would use in court later on 

    The reason for not getting it yet is because they may not fill in the claim form with sufficient details, meaning that you can truthfully state in your defence that the claim is deficient, as seen in numerous other threads that contain woeful P.O.C details on them

    Having their SAR reply could hamper you or handcuff your truthful claim response 

    So if you already have all the paperwork and pictures and have already obtained pictures of signs plus highways information from Manchester council, a SAR wont help you and could hinder you in the future 

    So better to gather your paperwork and Exhibits now, but play the long game if possible, hoping that SIP make mistakes

    Update: Manchester Council have eventually confirmed that the road I was parked on is "Maintainable at Public Expense". To my mind, this proves that i was not parked within the boundary of the Trading Estate and therefore outside the remit of the SIP Parking Contractor. I'm sure I've read somewhere that Private Contractors cant ticket on Council roads.... Can anyone confirm my thought process?

    Correct, if its council roadway, its not private property and SIP cannot and should not ticket the vehicle 

    I think Vcs or Excel were caught ticketing on public highway a few years ago, it didn't go well for them 

    You should probably inform SIP of this and add a copy of the response from the council, stating that the document will be used in court if they dont cancel the PCN ASAP

    Definitely, plus emphasise that you deny any liability for the debt on the following basis, blah blah 
  • Hi, how did this go? I recently got a ticket on the same trading estate and also feel I was parked on a public road rather than a private one which the sign indicates.
