Update to this... Excel are proceeding to take this to court, 15th April. I have sent a witness statement using previous successful court outcomes reported on here and quoting IPC guidelines etc.
Just as I was about to send it I received am email with their witness statement and found several errors. The contract ended two years ago with no evidence to show it was valid on the date. Plus the plan and pics of the car park were for several adjacent car parks and not the area we were parked in! So I quickly did an addition to the defendants statement with pics and now hope these errors are the golden ticket!3 -
Are all the claimant's photos date and time stamped relevant to the parking event?3

I wouldn't have tipped them off about the errors... hopefully you didn't? If they get wind of errors they'll send a supplementary WS next week.

Not sure if their pics are date stamped but their pic of a sign in a car park does not seem to be in the right car park. I had to send them everything I sent to the court but am hoping they do not look before the day.2

Probably too late now but from earlier posts it is clear they used the wrong wording when claiming compliace with POFA "28 days from issue" is incorrect, it should be "28 days beginning with the day after the notice is given".
This has been enough to beat Excel/VCS in the past.Always remember to abide by Space Corps Directive 39436175880932/B:

Case dismissed!!! My DW was unwell so I went to court and the judge allowed me to be a Lay representative in spite of the claimants solicitors objections. We had submitted the usual witness statement but on the last day to post the claimants witness statement was emailed to us. This showed the contract with the landowner ended in 2021 plus the car park plan showing signs and boundaries was not accurate, so I made another short statement and labled it additional information and put that with the witness statement.
The judge was very concise and went through all the papers carefully. Then said that she concluded that there probably was an extension of the contract. However there was no evidence that a disabled person would be able to see clearly any signs at the entrance or where we parked so no contract was made and dismissed the claim.
Took about 1.25 hours. The Excel rep was a Mr Ali from Adams solicitors. District Judge Anwar at Lincoln County Court.9 -
